The proposal would have used CMS physician work time values as a threshold for reviewing reported anesthesia minutes in Connecticut, New York, and Missouri. It concerned whether claims would be reimbursed—not an instruction to stop anesthesia care when a clock ran out.
What Anthem proposed—and what it did not
In November 2024, Anthem announced a proposal to compare anesthesia minutes reported on claims with insurer-selected thresholds based on CMS physician work time values. Contemporaneous Associated Press reporting said claims reporting time above the established number would be denied. The proposal was announced for certain plans in Connecticut, New York, and Missouri, with a February 1, 2025 effective date. Reports described exemptions for maternity care and patients under age 22. This was a reimbursement and claims-review proposal, not a clinical time limit. The reporting does not say that anesthesiologists would be told to stop care, wake patients, or leave when the threshold was reached. Nor does it establish that every patient would automatically owe the full cost of time above the proposed threshold; that would depend on plan terms, network arrangements, and applicable law.
When Anthem reversed course
On December 5, 2024, Anthem said it would not proceed. The company said it had decided against the change because of what it called “significant widespread misinformation.” That is Anthem’s explanation, not an independently established account of why it changed course. ABC News quoted Anthem as saying: “To be clear, it never was and never will be the policy of Anthem Blue Cross Blue Shield to not pay for medically necessary anesthesia services.” ABC News, December 5, 2024.

The reversal followed public criticism and reported contacts from state officials. Connecticut Comptroller Sean Scanlon said his office contacted Anthem; New York officials also said they intervened. Anthem announced it would withdraw the planned change across the affected plans, including those in Missouri. The sequence shows that public backlash and official pressure accompanied the reversal, but does not establish a single cause or reveal the company’s internal decision-making. Why the proposal drew criticism
The American Society of Anesthesiologists opposed the proposal. The professional society argued that procedure duration varies and anesthesia care is individualized, so a fixed threshold could fail to reflect the time a particular patient’s care requires. ASA called the proposal “deeply flawed” and criticized payment restrictions as a response to costs. Those are the society’s arguments; the available reporting does not document patient-safety outcomes caused by a policy that was withdrawn before implementation. ASA statement, December 6, 2024.

On December 10, 2024, Senators Richard Blumenthal and Josh Hawley wrote to Anthem seeking answers about its rationale, impact analysis, what would happen to services beyond the proposed limit, and why the states were selected. The letter records questions posed to the insurer; it does not establish Anthem’s answers or prove that the effects raised in the questions occurred. Letter to Anthem, December 10, 2024.
How the proposal differs from ordinary anesthesia time billing
Anthem’s July 2, 2024 commercial reimbursement policy described anesthesia time as beginning when preparation for anesthesia starts and ending when the provider is no longer in personal attendance. It also said reimbursement was subject to applicable federal and state law and the member’s benefits on the date of service. That document describes time recording and general reimbursement terms; it is distinct from the withdrawn proposal to use time thresholds for claims review. Because the document is dated 2024, it should not be treated as confirmation of Anthem’s current policy without checking for a later revision. What this means for members with an anesthesia claim
The withdrawn proposal is not evidence that Anthem currently denies every claim that includes extended anesthesia time. The sources establish the proposed change and its reversal, not the current adjudication of every claim or the terms of every member’s plan. If you are reviewing a specific bill or denial, use your plan document and the claim-specific explanation of benefits to understand the stated reason, then check the provider’s network status and applicable state requirements. Those details determine an individual claim and cannot be inferred from the 2024 proposal.
