What did Fox argue, and what happened procedurally?
Rolling Stone reported that Fox and Jesse Barrett sought dismissal, arguing that the suit was filed too late and that the gist of the reporting was true even if some details were inaccurate. Those are the defendants’ arguments, not a ruling or a finding that the reporting was true.
A docket mirror for No. 1:2024cv03392 lists a motion to dismiss filed May 3, 2024, Redmond’s response filed May 31, and the defendants’ reply filed June 21. The mirror says discovery was stayed pending a ruling on the motion. The figures reported in connection with the case refer to different things:
- More than $1 million: damages allegedly sought in the complaint, as reported by Rolling Stone.
- $3 million: the amount Redmond’s summons to Fox and affiliates reportedly demanded, according to Rolling Stone. A summons demand is not an award or a court finding.
