Possibly. In the United States, selling a tool secondhand does not by itself determine whether you could be held responsible if someone is injured. The answer can depend on your state’s law, whether you sold the tool privately or as part of a business, its condition and history, what you knew or said about it, and how the injury occurred. Federal product-safety rules also apply to secondhand sales.
What determines whether a used-tool seller may be liable?
There is no single nationwide rule that makes every private seller liable—or automatically exempts every private seller—when a used tool injures someone. A civil claim may turn on the law of the relevant state and the specific facts, including the seller’s role, the tool’s condition, any modifications or repairs, statements made during the sale, and the link between the product and the injury.
Product-safety rules and civil liability are separate questions. Federal rules can restrict the sale of a recalled or otherwise noncompliant consumer product, while a claim for injury damages is generally analyzed under applicable state law. Compliance with one does not decide every possible claim under the other.
Does it matter whether you sold the tool privately or commercially?

How do state product-liability rules illustrate the differences?
South Carolina
South Carolina Code § 15-73-10 provides that a seller engaged in the business of selling a product may be liable when it reaches the user or consumer in a defective condition unreasonably dangerous to that person. The statute also addresses whether the product reached the user without substantial change. It says the rule can apply even if the seller exercised all possible care and even if the injured person did not buy directly from that seller. This is a South Carolina rule, not a nationwide standard.
Texas
Texas Civil Practice and Remedies Code Chapter 82 defines a products-liability action broadly to include claims against a manufacturer or seller for damages allegedly caused by a defective product. The possible legal theories include strict liability, negligence, misrepresentation, warranty, or another theory. The chapter defines a seller by reference to commercial-purpose activity in distributing or placing a product in commerce. That statutory framing should not be treated as the rule in other states.

Kansas
Kansas Statute § 60-3306 contains a conditional defense for certain retail sellers of used products. Among the cited conditions are resale in substantially the same condition as when acquired and a manufacturer subject to service of process with a judgment reasonably certain to be satisfied. The cited Kansas Legislature page is an older session source, so check the current statute and all applicable conditions before relying on it. It is not a general exemption for all private sellers or all used-product sales.
Does an “as-is” sale protect you?
Do not assume that “as is” automatically eliminates product-safety duties or prevents an injured buyer from bringing a claim. The effect of a disclaimer or waiver depends on the governing law and facts; the cited sources do not establish a general rule that an “as-is” label is a complete defense. Describe known defects accurately rather than treating that phrase as a substitute for disclosure or a safety check.

What federal safety rules apply to secondhand tools?
The Consumer Product Safety Commission says consumer-product laws and regulations apply to people who sell or distribute consumer products, including thrift and consignment stores, charities, and individuals holding yard sales or flea markets. Its resale guidance recommends examining used products to ensure they are safe and comply with federal law.
The CPSC says secondhand sellers do not need a CPSC license and resellers do not need to test and certify the products they resell. It nevertheless advises sellers to check products for safety and recall status. The agency states that recalled products may not be sold and that resellers—including sellers using auction sites—as well as people giving used products away cannot knowingly transfer products that fail applicable legal requirements. The CPSC’s Online Sellers’ Safety Guide puts the recall rule plainly: “It’s important to know that it is illegal to sell any recalled product.”

What should you do before selling a used tool?
These practical steps can help you identify hazards and communicate accurately, but they are not a legal safe harbor or a guarantee against a claim.
- Identify the tool. Record its make and model so you can check relevant safety information and recall notices.
- Check for recalls. Do not sell a tool that has been recalled. If its legal or safety status is unresolved, pause the sale until you have clarified it.
- Inspect for visible problems. Look for missing guards, damaged cords, cracked housings, altered safety features, and improvised repairs. A visual inspection cannot establish that every tool is safe.
- Describe its condition accurately. Disclose known defects, repairs, modifications, and limitations; do not claim that a tool is safe or fully functional if you cannot support that statement.
- Keep a record of the transaction. Save the listing and sale messages, and note the tool’s condition and any known repair or modification history.
What if someone has already been injured?
Preserve the listing, messages, and other sale records. Identify the tool and document known repairs or modifications; avoid discarding or altering relevant evidence. Because the applicable law depends on the jurisdiction and circumstances, contact a lawyer in the relevant state promptly for advice about the specific claim.
