Yes—a landlord’s requirement under Uttar Pradesh’s 2021 tenancy law need not always mean the landlord will personally occupy the premises. In Keshav Bhalla v. Prescribed Authority / Rent Authority (Additional District Magistrate and Another), the Allahabad High Court declined to overturn an order requiring a shop tenant to leave after the landlord sought the premises for an unemployed son’s business. The reported rule is narrower than “a landlord can evict a tenant for any relative”: the proposed use must have a genuine connection to the landlord’s circumstances and interests.
What the Allahabad High Court decided
On September 23, 2026, Justice Yogendra Kumar Srivastava rejected Keshav Bhalla’s challenge under Article 227 of the Constitution to an order requiring him to surrender a shop in New Mandi, Muzaffarnagar. The Economic Times reported that the landlord, identified as Chhabra, sought the shop to establish a business for his unemployed son. Why a son’s proposed business may count—and what it does not establish
As the Economic Times account explains the court’s reasoning, Section 21(2)(m) contains two contingencies. The phrase concerning occupation by the landlord is more naturally connected to the second contingency, involving demolition and new construction; it does not necessarily impose a personal-occupation requirement on the first. That means a landlord’s statutory requirement may involve a family member’s intended use.

But family relationship alone is not enough. The reported standard requires a “genuine and legitimate nexus between the requirement asserted and the circumstances and interest of the landlord.” A landlord therefore cannot establish the relevant requirement simply by saying that a son, or another relative, wants the property. The proposed use must be shown to connect genuinely to the landlord’s own circumstances and interests.

- The shop was reportedly rented for ₹12,000 a month. Bhalla said he paid rent regularly, but that the landlord stopped accepting it in 2022.
- The landlord applied for eviction under Section 21(2) of the 2021 Act and reportedly served a notice under Section 106 of the Transfer of Property Act, 1882, on March 19, 2024.
- The Muzaffarnagar Rent Authority rejected the application on February 13, 2025. On appeal, the district court ordered the tenant to surrender possession on May 13, 2026.
- Bhalla then sought supervisory review by the High Court under Article 227. The High Court rejected his challenge on September 23, 2026.
Why Article 227 review was not a fresh hearing
Article 227 gives a High Court supervisory authority over courts and tribunals; it is not ordinarily another opportunity to retry the evidence or replace lower authorities’ factual conclusions with a new assessment. The Economic Times reported that the High Court found no basis to interfere with the concurrent findings for the landlord, stating that they had not been shown to rest on no evidence, disregard a material circumstance, or involve jurisdictional error, manifest error of law, or perversity.
That distinction matters: the High Court’s refusal to intervene does not mean every factual or legal issue in a tenancy dispute is beyond review. The report says intervention may be warranted for perverse or arbitrary findings, findings based on no evidence, material legal misdirection, or jurisdictional error. Its point here was that the challenge did not justify supervisory interference with the findings already made.

What the ruling says about alternative accommodation and hardship
The Economic Times account says alternative accommodation and comparative hardship are not automatically independent statutory prerequisites under the 2021 Act provision in the same way they appeared in the earlier rent-control framework. That is a point about this statutory scheme and the reported decision, not a blanket rule that relevant facts about available premises or hardship can never be raised in a tenancy dispute.
Vacating period reported for this tenant
The Economic Times reported that Bhalla was given six months to vacate, at the request of his lawyer. That is the period reported in the October 6, 2026 account; it should not be treated as an unexpired deadline without checking for later orders or developments.
