Hector “H3CZ” Rodriguez, professional Call of Duty player Seth “Scump” Abner, and HECZ LLC sued Activision Blizzard in federal court on February 15, 2024, seeking $680 million in damages. Who sued Activision, and what did they ask for?
The plaintiffs were Rodriguez, Abner, and HECZ LLC—not simply an esports organization. The federal case, No. 2:24-cv-01287 in the U.S. District Court for the Central District of California, was filed on February 15, 2024. The complaint described Abner as having 30 major championship wins at the time it was filed. That is the complaint’s count at filing, not an independently audited or current career total.
What was the $680 million lawsuit about?
The plaintiffs’ central theory was that Activision controlled access to the Call of Duty game and its professional competition in ways that allegedly shut out rival professional leagues or tournaments. They said the company acquired Major League Gaming and later established the Call of Duty League, then used its position to restrict competing events.

The complaint also challenged the effect of participation terms on teams’ and players’ ability to enter the market, own or operate teams, earn revenue, secure sponsorships, stream, and pursue other commercial opportunities. These were allegations in a private antitrust complaint, not findings that Activision violated the law. The requested $680 million likewise represented a claimed remedy, not established losses.
What happened in court—and did H3CZ and Scump win?
- February 15, 2024: Rodriguez, Abner, and HECZ LLC filed the complaint seeking $680 million.
- March 1, 2024: The plaintiffs filed a stipulation seeking to move the dispute into arbitration.
- March 11, 2024: The Central District of California granted the stipulation and dismissed the federal action because the claims were subject to arbitration. The dismissal order was procedural; it did not resolve the merits or decide damages.
A secondary Los Angeles County docket listing reports that Activision Blizzard, Activision Publishing, and Call of Duty League filed a petition on March 2, 2026, concerning confirmation, correction, or vacatur of an arbitration award. The listing showed the petition as pending. The award and a final court ruling are not established by the available record described here, so it is not possible to say that either side won, that damages were paid, or that the complaint’s allegations were proven.

How this differs from the Justice Department’s Activision case
The private $680 million case is separate from the Department of Justice’s 2023 civil antitrust action. The DOJ challenged a so-called Competitive Balance Tax in Activision’s Overwatch and Call of Duty leagues, alleging that it penalized teams when player compensation exceeded thresholds. That matter ended in a final judgment that prohibits Activision from directly or indirectly imposing an upper limit on player compensation or penalizing a team for exceeding a compensation amount. The DOJ announcement describes the government’s separate case; its outcome does not decide Rodriguez and Abner’s claims or establish their requested damages.

As reported by GameSpot on February 16, 2024, an Activision Blizzard spokesperson called the suit “no basis in fact or in law” and said the company would strongly defend against the claims. The spokesperson also said the company was disappointed that members of the esports community had brought the suit, describing it as disruptive to people invested in the Call of Duty League. These were the company’s responses as reported by GameSpot, not court findings.
