A federal judge initially blocked Texas’s App Store Accountability Act, but that is no longer its practical status. A Fifth Circuit panel stayed the injunction on June 4, 2026, allowing Texas to enforce Senate Bill 2420 while the appeal continued. On July 6, the Supreme Court declined to intervene in that emergency dispute; it did not decide whether the law is constitutional.
What is Texas Senate Bill 2420?
Senate Bill 2420, also called the App Store Accountability Act, established an age-verification and parental-consent system for app stores and developers. It was scheduled to take effect January 1, 2026.
- App stores would verify the ages of users accessing their stores.
- For minors, the system included linking the account to a parent and obtaining parental consent. Parental approval applied to app downloads and in-app purchases.
- Apps would receive age ratings and provide content disclosures.
Those are statutory requirements; they should not be read as a claim that every app store implemented them in the same way.

So, “a federal judge blocks the Texas app store law” describes the district court’s initial order, not the latest enforcement posture established by these proceedings. The preliminary injunction was stayed, and SB 2420 could be enforced while the underlying litigation continued.

Why did Judge Pitman block the law?
Pitman concluded at the preliminary-injunction stage that the challengers were likely to succeed on their First Amendment claim. The district court viewed app-store access as implicating speech and found the law likely overbroad and inadequately tailored. This was a prediction about the challengers’ likelihood of success—not a final judgment after trial.
To illustrate the breadth of the system, Pitman compared it to a rule for bookstores: “The Act is akin to a law that would require every bookstore to verify the age of every customer at the door and, for minors, require parental consent before the child or teen could enter and again when they try to purchase a book.” District court order

Why did the Fifth Circuit allow enforcement to resume?
The Fifth Circuit reached a different interim assessment when it considered Texas’s request to pause the injunction. In its June 4 stay order, the panel said Texas had made a strong showing of likely success on appeal. It reasoned that significant parts of SB 2420 likely regulated commercial speech subject to intermediate scrutiny. Fifth Circuit order
That analysis supported a stay pending appeal; it was not a final ruling resolving the First Amendment dispute. The courts’ differing views reflect both a disagreement over how the law should be analyzed and the limited, preliminary posture of each decision.

What the Supreme Court’s action does—and does not—mean
By declining emergency relief on July 6, 2026, the Supreme Court left the Fifth Circuit’s stay undisturbed. That action was not a final merits ruling that SB 2420 is constitutional, nor did it end the underlying cases. The law’s enforceability described here follows from the stay while the litigation proceeds.
