The amount is often rounded to €800 million, but the Commission’s exact figure is €797.72 million.
This was an EU antitrust decision under Article 102 of the Treaty on the Functioning of the European Union and Article 54 of the EEA Agreement—not a privacy or consumer-protection fine. Meta challenged the decision. A separate 2026 ruling about Marketplace’s Digital Markets Act designation did not overturn this fine.
What the Commission found
The Commission opened its investigation in June 2021, sent Meta a statement of objections in December 2022, and received Meta’s response in June 2023. Its November 14, 2024 decision found two forms of abusive conduct involving Facebook Marketplace:
- Tying Marketplace to Facebook: Facebook users automatically had access to Marketplace and were regularly exposed to it. The Commission said this gave Marketplace a distribution advantage that competing classified-ad services could not match.
- Unfair conditions for rival advertisers: The Commission found that Meta’s terms allowed it to use advertising-related data generated by competing online classified-ad providers advertising on Facebook and Instagram for the benefit of Marketplace.
The Commission’s public summary does not specify every contractual clause or data field, so it does not support claims that Meta “stole” particular information or that every Marketplace seller’s data was unlawfully used. Its finding concerned the relationship with competing classified-ad providers and the use of advertising-related data.

Why Marketplace’s connection to Facebook mattered
The Commission’s theory was that Meta could use its position in personal social networking to advantage its own service in the separate market for online classified advertising. Automatic access and regular exposure could steer attention toward Marketplace in a way that rival services could not replicate simply by competing on their own merits.
Product integration is not automatically illegal, and the decision was not a finding that users were forced to list or buy anything. Under EU abuse-of-dominance rules, being dominant is lawful; abusing that position is not. The Commission found Meta dominant in the market for personal social-network services, which it described as at least EEA-wide, and in national markets for online social-media display advertising. How the Commission set the €797.72 million fine
The Commission said it considered the duration and gravity of the infringement, Marketplace-related turnover to help set the basic amount, and Meta’s overall turnover to ensure deterrence. It did not describe the fine as a fixed percentage of global revenue or as compensation for particular losses. The decision also ordered Meta to end the conduct and not repeat it or adopt equivalent practices. The Commission’s summary does not establish whether or when the fine was paid.
Meta’s response and appeal
Meta disagreed with the decision. In its response, the company argued that the Commission had not demonstrated harm to competitors or consumers, said it would comply with the order, and appealed. Those are Meta’s positions, not a court’s conclusion about whether harm occurred.

Meta’s action for annulment of the November 2024 decision was published in the EU’s Official Journal on January 28, 2025, under antitrust case AT.40684. The publication records the challenge and its grounds; it does not decide them. The official sources cited here do not establish a final judgment on the fine as of August 18, 2026. Who receives the money?
The €797.72 million is an administrative fine, not a damages award. The Commission says antitrust fines go into the general EU budget and are not earmarked for particular expenses. The decision therefore does not automatically pay money to Facebook users, Marketplace buyers or sellers, or rival businesses. A party that believes it suffered loss may pursue a separate damages claim where legally available; that is distinct from the Commission’s public enforcement decision.

What this means for Facebook users, sellers, and competing services
- Facebook users: The decision did not ban Marketplace or require users to stop using it. The Commission’s concern was how Marketplace was distributed within Facebook.
- Marketplace sellers and buyers: The Commission’s public summary does not say ordinary listings must stop or promise users compensation.
- Competing classified-ad providers: The decision addresses the competitive advantage the Commission attributed to Facebook’s integration and the conditions Meta imposed on rivals advertising through Facebook and Instagram.
- Advertisers: The data-related finding concerns advertising-related data generated by competing classified-ad providers; it should not be generalized to every advertiser or every kind of user data.
The separate 2026 ruling on Marketplace’s DMA designation
On June 3, 2026, the EU General Court annulled the Commission’s separate designation of Marketplace as a gatekeeper core platform service under the Digital Markets Act (DMA), while maintaining Meta’s DMA designation for Messenger. In Case T-1078/23, the court said the Commission had not properly accounted for relevant changes Meta made to Marketplace in 2023 and had not adequately explained whether the service enabled business users to offer goods and services to consumers. The court’s press release said an appeal limited to points of law could be brought within two months and ten days of notification. That judgment concerns a 2023 DMA designation, not the Commission’s 2024 antitrust infringement decision. It does not cancel the €797.72 million fine or determine the separate appeal in case AT.40684.
