If someone posts or uses a picture of you without permission, that does not automatically make the use illegal—or give you ownership of the photograph. In the United States, the photographer usually owns copyright in the image, while your possible privacy or publicity rights concern how your identity is used. The right response depends on where you and the other person are, where and how the image was used, who made the photograph, and what it depicts.
First, identify what kind of use you are dealing with
Start by distinguishing the photo itself from your face, name, or identity. Copyright protects the photograph as an original creative work. Privacy and publicity laws may apply to uses of a person’s identity, but those laws vary by state and by context. The U.S. Copyright Office describes state privacy and publicity rights, alongside federal frameworks, as relevant to unauthorized digital replicas; no single rule covers every image use. - Advertising or product promotion: A business using your image to suggest an endorsement may raise a right-of-publicity issue, depending on the applicable law and facts.
- News, commentary, or criticism: The context may matter to privacy, publicity, and copyright questions. Do not assume that an image is unlawful merely because you did not approve its use.
- Intimate imagery, threats, or a digital replica: Separate state laws or other legal frameworks may apply. These situations can be urgent, especially if a minor is involved; consider getting advice from a licensed attorney.
- Private or personal sharing: The platform’s rules and the circumstances of the sharing may matter, but there is no universal permission rule for every situation.
Depending on the facts and jurisdiction, other legal categories—including defamation, biometric privacy, or laws concerning nonconsensual intimate imagery—may also be relevant. These are possibilities to discuss with counsel, not claims that necessarily apply to a particular post. Nolo’s overview offers general orientation, not a state-specific legal determination.
Who owns the photograph’s copyright?
Usually, the person who took an original photograph owns its copyright from the moment it is fixed. The Copyright Office says, “Copyright protection exists from the moment you take a picture.” U.S. Copyright Office, What Photographers Should Know about Copyright.

Being the person pictured does not, by itself, make you the copyright owner. Nor does having a copy of the photo transfer copyright. The Copyright Office explains that the photographer generally owns the copyright, although employment, work-made-for-hire arrangements, a written transfer, or later ownership changes can affect who owns it. If you took the picture, check whether an employment arrangement or written agreement changed ownership. If someone else took it, ask who owns the copyright before treating a copyright complaint as your own. A business, client, employer, or assignee may own or control the rights in some circumstances.

Which route could address the use?

These routes are not interchangeable. In particular, the fact that your likeness appears in a photograph does not authorize you to file a copyright takedown for an image owned by someone else. A platform may still have its own rules for privacy, impersonation, or other complaints.
What to do before reporting the image
- Save a record. Keep the page URL, screenshots showing the image and surrounding context, the date you found it, the account or publisher name, and relevant messages. These are sensible documentation steps, not legal filing requirements.
- Identify the image and its owner. Note who took the photo, whether you took it yourself, and whether an employer or written agreement may affect ownership.
- Describe the use accurately. Record whether it appears in an advertisement, a news or commentary post, a personal account, an intimate-image post, or a digital replica. Keep the full context rather than only a cropped image.
- Use the platform’s applicable reporting process. Follow its current instructions and choose a category that matches the concern. Do not submit a DMCA notice unless you own the copyright or are authorized to act for its owner.
- Get legal advice when the stakes or complexity are high. Commercial exploitation, intimate imagery, threats, minors, significant harm, or conduct crossing borders are strong reasons to consult a licensed attorney. Can the person who posted it claim fair use?
Possibly, but fair use is a case-specific copyright analysis, not an automatic permission to use a photo. The Copyright Office says there is no fixed number of words, copies, or percentage that guarantees a use is fair; a court determines whether a particular use qualifies. Credit, noncommercial use, editing, or using only part of an image does not by itself settle the question. U.S. Copyright Office, Fair Use FAQ.

Fair use concerns copyright in the photograph. It does not, on its own, answer whether a particular use of your identity violates a privacy or publicity law that applies to the situation.
