In the United States, election-related event contracts sit amid an ongoing dispute between federal and state authorities, and state restrictions can matter even when a platform says it is federally regulated. Before participating, check the law where you are, your eligibility, and the specific contract’s terms. Here’s what political betting means, what the law currently establishes, and how to interpret market prices.
What is politics betting?
Politics betting usually means buying or trading an event contract whose value depends on the outcome of an election or another political event. A contract might, for example, be tied to whether a specified candidate wins or a party controls a legislative chamber. The precise wording matters: it defines the event, the deadline, and how the outcome is determined.
The Commodity Futures Trading Commission (CFTC) calls these products event contracts. The agency says prediction markets in the United States have existed since 1988 and that it has regulated them since 2004; those dates describe the CFTC’s account of its framework, not a conclusion that every political contract is lawful. In practical terms, a market price is a quote at which participants may be willing to trade under a contract’s terms. It is not a guaranteed forecast or an unconditional promise of payout. The contract’s settlement criteria and the platform’s policies determine what happens when the event is resolved.

Is betting on the election legal?
There is no single answer that applies to every platform, contract, state, and participant. Federal oversight and state gambling or election-betting rules overlap, and their boundaries are being contested. The CFTC has asserted exclusive jurisdiction over these markets in litigation, but that is the Commission’s position—not a final, universal resolution of the dispute. Are prediction markets legal in my state?
A national statement about CFTC oversight cannot determine whether a particular contract is available or lawful for you. State laws and court orders may change, and some rules apply to people in particular roles, including election officials or poll workers. Platform access is also not proof that a contract is lawful for every user in every jurisdiction.

Before trading, check these points:
- Your location: Look for current state restrictions and relevant court orders; consult a qualified lawyer if the legal answer affects an important decision.
- Your role: If you work in election administration, serve as a poll worker, or have access to nonpublic election information, check for role-specific restrictions and platform rules.
- The exact market: Read the contract’s wording, settlement criteria, and the source used to determine the outcome.
- The operator and product: Confirm what regulatory framework applies to the specific operator and contract. Do not assume all platforms or political markets have the same status.
- Trading terms: Review fees, liquidity, and any limits on exiting a position directly on the platform; these details can vary by market and over time.

Are betting market odds more accurate than polls?
A price can be read as a market-implied probability under the contract’s terms, but that reading is not a guarantee. It reflects trading in a particular market, which can be affected by who participates, how much trading occurs, and the contract’s design. It should not be treated as a direct measurement of voter preference.

The CFTC’s prediction-market explainer does not establish that political-market prices outperform polls. Without a comparable performance study specifying the markets, elections, polling benchmarks, and evaluation method, it is not sound to claim that odds are inherently more accurate. When comparing a market price with a poll, first check whether they address the same question and time period. A poll reports responses from a surveyed group under its own methodology; a contract price concerns the outcome as defined by its settlement rules. Neither should be read without its underlying terms and limitations.

What risks and integrity rules should participants understand?
Political event contracts raise integrity concerns as well as financial and legal ones. The CFTC’s enforcement advisory addresses fraud and misuse of nonpublic information in prediction markets. Kalshi’s market-integrity materials describe prohibited activity, trader restrictions, and oversight processes. Those policies are the platform’s statements about its rules; their existence does not demonstrate that misconduct is impossible or always detected. Do not trade on information you are not permitted to use, and do not assume a political contract is a casual wager with simple settlement. Read the platform’s current rules and the contract itself before committing money. A displayed price may move, and your ability to exit can depend on market conditions and platform terms.

How to assess a political event contract
- Identify the exact event. Read the full contract question and note the deadline and resolution criteria.
- Verify the legal and eligibility context. Check the current rules for your state and any restrictions that apply to your role, then confirm the platform’s own eligibility terms.
- Understand settlement. Find out which source or process decides the result and what happens if the event is delayed, disputed, or not resolved as expected.
- Review trading conditions. Check fees, liquidity, and exit options for that market rather than assuming they are the same across contracts.
- Interpret the price cautiously. Treat it as a market quote under the contract’s terms, not a certain prediction or a substitute for polling analysis.
- Read integrity rules. Make sure you understand restrictions on trading, use of information, and other prohibited conduct.
