New York Attorney General Letitia James sued Valve on February 25, 2026, alleging that paid loot boxes in games including Counter-Strike 2, Team Fortress 2, and Dota 2 amount to illegal gambling under New York law. The state says users pay for keys to open randomized containers and that some resulting virtual items can be resold for money. Those are allegations in an unresolved case—not a court finding that Valve broke the law.
What New York alleges Valve did
The lawsuit, filed by the People of the State of New York through Attorney General James, names Valve Corporation and invokes New York Executive Law § 63(12). The complaint concerns paid randomized-item mechanics in the Counter-Strike, Team Fortress, and Dota franchises; James’s announcement specifically names Counter-Strike 2, Team Fortress 2, and Dota 2. The Attorney General’s announcement and the filed complaint describe the state’s claims.
According to the complaint, players pay for keys that unlock containers and receive one item from a randomized set. The state argues that the chance-based outcome, combined with the alleged monetary value of rare items, makes the transactions gambling under state law. The complaint is the plaintiff’s account of the case; its assertions are not findings of fact.
Why resale value is central to the state’s theory
New York’s argument depends in part on its contention that some virtual items can have monetary value because users may trade or sell them. The complaint distinguishes activity on Steam’s own marketplace from resale through third-party marketplaces. These are different routes, and the case’s theory should not be read as establishing that every item can be converted into cash, that all items have a stable market price, or that a particular resale transaction occurred.

The Attorney General’s announcement cites a Counter-Strike skins market reportedly worth more than $4.3 billion as of March 2025, but the underlying report and methodology are not identified in the available material. It also mentions an item reportedly sold for more than $1 million in June 2024. These are figures reported by the Attorney General, not proof of typical item values or independently established market-wide measurements.
What New York is asking the court to do
The state seeks an injunction to stop the conduct it alleges is illegal, disgorgement of alleged ill-gotten gains, and fines. These are requested remedies. Filing the lawsuit did not itself grant an injunction, order Valve to pay money, or resolve whether the mechanics violate New York law.

What is established—and what remains unresolved

James said in the announcement, “Illegal gambling can be harmful and lead to serious addiction problems, especially for our young people.” That is the Attorney General’s statement. The announcement also refers to research on youth gambling risk without identifying the underlying study, so the claim should not be treated here as independently verified evidence about these games or their players.

A lawsuit can put a business practice under legal scrutiny without changing the rules for players immediately. The practical questions—whether the court will treat these paid randomized mechanics as gambling, how it will assess the alleged resale pathways, and what relief might follow—remain contested. The case is about the state’s allegations against Valve, not a ruling that every loot box or virtual-item marketplace is illegal.
