In a unanimous 9 October 2019 ruling, the court rejected rural unions’ challenge to royalties on Monsanto’s patented Roundup Ready soybean technology. The US$7.7 billion figure was a contemporary estimate of royalties in dispute, not a damages award.
What the Brazilian court decided
The STJ’s Second Section ruled in IAC 4 on 9 October 2019. It held that the limits on intellectual-property rights in Article 10 of Brazil’s Plant Variety Protection Law (Law 9,456/1997) could not be invoked against patent holders for products or processes related to transgenics when that technology is present in reproductive material of plant varieties. The court unanimously rejected the unions’ appeal. The STJ’s summary of the decision and the IAC 4 judgment hosted by WIPO Lex describe the ruling.
What farmers and unions had sought
Rural unions from Rio Grande do Sul brought the collective case against Monsanto entities. They sought recognition that growers could save Roundup Ready soybean seed for replanting and sell the harvest as food or raw material without an additional royalty, technology fee, or indemnity. For small producers, the claim also covered donating or exchanging saved seed. An earlier lower-court ruling had granted forms of this relief; the STJ rejected the unions’ appeal.
Can Brazilian farmers save and replant patented soybean seed?
The ruling was not a blanket decision that farmers may never save any seed. It addressed patented transgenic technology and the relationship between patent rights and plant-variety protections invoked by the unions. In this case, the STJ held that Article 10’s limits for holders of plant-variety protection certificates did not displace patent rights over the transgenic products or processes at issue.

That distinction matters: the decision concerned the technology and legal claims before the court, not every seed, crop, patent, or farming practice in Brazil. The case should not be read as a general ruling on all seed-saving rights.
What the US$7.7 billion figure means
A 2019 article in The Conversation, republished by Scroll.in, described US$7.7 billion as the estimated royalties in dispute in the collective action. It was a reported estimate, not a sum the STJ ordered farmers to pay and not damages awarded by the court. The distinction is central to understanding the headline: the STJ ruled on the legal basis for protecting transgenic technology and royalty obligations, not on a US$7.7 billion damages claim. The 2019 report is the source of the estimate.

Separate Brazilian cases are not part of this ruling
Intacta RR2 PRO royalty deposits
A separate dispute concerns Monsanto’s Intacta RR2 PRO soybean technology. In March 2024, Brazil’s Supreme Federal Court (STF) maintained an obligation for Monsanto to deposit royalties received under a soybean patent in court. That is a different patent and proceeding from the STJ’s 2019 IAC 4 case about Roundup Ready technology. The STF’s 2024 account describes the deposit obligation.
CADE’s 2026 recommendation
On 23 July 2026, Brazil’s competition authority, CADE, said its General Superintendence recommended that Monsanto Company, Monsanto do Brasil, Bayer AG, and Bayer S.A. be convicted over alleged anticompetitive practices involving incentives to adopt Intacta RR2 PRO and discounts for soybean seed multipliers. This was a recommendation, not a final conviction: CADE said the final analysis would be made by its Tribunal. It is separate from the STJ’s 2019 ruling. CADE’s announcement gives the procedural status.
