The February 15, 2022 report describes a dispute over intellectual-property rights—not a court ruling—and does not establish what happened to the project afterward.
What MtgDAO proposed
In a report published February 15, 2022, Futurism’s Noor Al-Sibai said MtgDAO proposed that people who owned specified physical Magic cards could mint them as NFTs. The NFTs could then be eligible for tournament play, according to the report.
MtgDAO’s stated rationale, as summarized by Futurism, was that participants already owned the physical cards and that the NFTs would preserve scarcity. The report does not establish that the project launched or that this ownership rationale was accepted as legally valid.
The group’s white paper, as quoted by Futurism, said: “I think crypto and the world of DAO’s can take this game to the next fucking level,” and described a plan to build a protocol “legally” over the existing game. Those are the group’s claims, not an independent legal assessment.
#1 Best Overall
- Includes a mix of AT LEAST 25 Rares/Uncommons which is half of the cards.
- Absolutely NO... Basic lands, Foreign, or silver/gold bordered cards.
- Some may contain Foils or Mythics but not all.
- Sets can range from Beta to the current Magic the Gathering set.
- Mint/Excellent condition only.
Why Wizards objected
Futurism reported that Wizards of the Coast objected that the proposed NFT use would infringe its copyrights and trademarks. The report says the company rejected the idea that restricting minting to people who had bought a physical card—or a card from an authorized online retailer—would make the proposed use lawful.
The letter reproduced by Futurism attributed this wording to Wizards’ lawyers: “Your enthusiasm for MAGIC: THE GATHERING is evident and appreciated.” It continued: “Unfortunately, your intended use of Wizards’ intellectual property, including its trademarks and copyrights, would be unlawful.” Futurism did not identify an individual lawyer as the author.

What the reported letter does—and does not—establish
The reported positions point to a disagreement over whether owning a physical card would authorize the proposed digital use of Wizards’ intellectual property. The source reports Wizards’ demand and MtgDAO’s proposal; it does not describe a court decision resolving that disagreement. A cease-and-desist letter is not, by itself, a judicial finding that infringement occurred.
Futurism’s closing question—“Who will end up minting the first Magic NFTs?”—captured the uncertainty when the story was published. The report does not establish whether MtgDAO later launched or abandoned the project, whether the parties settled, or whether a court ruled on the dispute.

Physical card ownership is not NFT permission
Buying a physical Magic card gives you the card; it does not, on the facts reported here, grant permission to mint an NFT or use Wizards’ intellectual property. That distinction is central to the dispute: MtgDAO’s proposal relied on card ownership, while Wizards reportedly maintained that the planned use of its copyrights and trademarks was unlawful. The report does not establish a court-tested legal rule for other NFT projects.
