Why a Judge Rejected Boeing’s 2024 Plea Deal Opposed by Crash Victims’ Families

A federal judge rejected Boeing’s 2024 proposed guilty plea over the agreement’s independent-monitor provisions and limited court oversight. The criminal case later ended under a separate non-prosecution agreement.

On December 5, 2024, U.S. District Judge Reed O’Connor rejected a proposed guilty-plea agreement between Boeing and the U.S. Department of Justice. The judge’s stated reason was not the families’ opposition by itself: he found that the agreement’s provisions for an independent compliance monitor gave the court too little oversight and were against the public interest. The criminal case later ended under a different arrangement, a non-prosecution agreement.

What plea deal did the judge reject?

The proposed agreement was submitted on July 24, 2024, in a federal criminal case in the Northern District of Texas. It concerned a one-count charge of conspiracy to defraud the United States, filed in January 2021. The Justice Department said the charge arose from Boeing employees’ deception of the FAA Aircraft Evaluation Group about the 737 MAX’s Maneuvering Characteristics Augmentation System (MCAS), affecting the FAA’s evaluation of the aircraft and information in pilot-training materials. In May 2024, DOJ told the court that it had determined Boeing breached obligations under its 2021 deferred prosecution agreement. The later 2024 proposal sought to resolve the criminal charge through a guilty plea. Judge O’Connor rejected it after an October 11, 2024 hearing. Why did the judge reject the agreement?

The order centered on the proposed independent compliance monitor and the court’s ability to oversee the arrangement. Judge O’Connor said the monitor-selection provisions were against the public interest and marginalized the court’s role. Those were the court’s conclusions about the terms of the proposal, not findings about what a monitor would ultimately have done.

  • A diversity-and-inclusion criterion: The agreement called for selection “in keeping with the Department’s commitment to diversity and inclusion.” The judge cited this provision in explaining his concerns about the selection process.

In the judge’s view, the combined terms left insufficient judicial oversight and risked undermining public confidence. Why did crash victims’ families oppose the plea?

Families of victims objected to the proposed agreement, including its treatment of the independent monitor and the court’s oversight. The families’ opposition and the judge’s rationale are related but distinct: the court’s order explains that it rejected the deal because of its monitor provisions and the resulting concerns about judicial oversight and public confidence. What was the 2021 deferred prosecution agreement?

The criminal case began with a 2021 deferred prosecution agreement (DPA), not the guilty plea rejected in 2024. DOJ’s January 7, 2021 announcement reported a total criminal monetary amount of more than $2.5 billion. It described the amount as comprising a $243.6 million criminal penalty, $1.77 billion in compensation to Boeing’s airline customers, and a $500 million fund for heirs, relatives, and legal beneficiaries of crash victims. What happened after the 2024 rejection?

The rejection did not end the criminal case. DOJ’s case chronology says the department reached a non-prosecution agreement with Boeing on May 29, 2025. On November 6, 2025, the Northern District of Texas granted the government’s motion to dismiss the charge. According to the DOJ case page, the Fifth Circuit denied families’ mandamus petitions, issued an amended opinion on May 22, 2026, and issued its mandate on June 18, 2026.
