Why Was Les Wexner Subpoenaed in the Epstein Investigation?

The House Oversight Committee authorized and formally issued a subpoena for Les Wexner, who gave a deposition on February 18, 2026. Here is what the record says—and what it does not establish.

Yes. The House Oversight Committee authorized and later formally issued a subpoena requiring Les Wexner to give a deposition as part of its inquiry related to Jeffrey Epstein. Wexner testified on February 18, 2026, and the committee announced the release of the video. The subpoena and deposition were investigative steps, not a finding that Wexner committed a crime or was legally liable.

What the House Oversight Committee did

The full committee authorized motions by voice vote on January 7, 2026, to subpoena Wexner, Darren Indyke and Richard Kahn for depositions, according to the committee’s report. At the time that report was drafted, the subpoenas were still being prepared. A later statement from the committee’s Democratic minority said the subpoenas had been formally issued after motions adopted on a bipartisan basis. The formal issuance and the earlier authorization are distinct procedural steps.

The minority statement described Wexner as a longtime benefactor of Epstein and gave the Democrats’ reasons for seeking his testimony. Those are the committee members’ characterizations of the inquiry, not findings of wrongdoing. The committee says Wexner’s deposition took place on February 18, 2026, and announced that it was releasing the video: House Oversight Committee deposition notice.

What Wexner said about Epstein

Before the deposition, Wexner said in a statement released to the House Oversight and Reform Committee: “I was naive, foolish, and gullible to put any trust in Jeffrey Epstein. He was a con man. And while I was conned, I have done nothing wrong and have nothing to hide.” The statement was Wexner’s account, not a committee conclusion. The Associated Press reported that he denied knowing about Epstein’s crimes or taking part in abuse.

AP reported that the deposition lasted six hours and that Chairman James Comer said Wexner answered every question asked. That description does not establish what the committee concluded about the answers.

What committee Democrats said about federal questioning

After the deposition, Ranking Member Robert Garcia said Wexner told the committee that the FBI and Department of Justice had never questioned him. That is Garcia’s characterization of the testimony. It should not be confused with whether federal agents considered investigative steps involving Wexner.

What AP reported about FBI records

In its review of released investigative records, AP reported that FBI agents considered serving Wexner with grand jury subpoenas in 2019. AP quoted an FBI agent’s August 16, 2019, email saying, “There is limited evidence regarding his involvement.” That sentence is the agent’s assessment in the email as reported by AP; it is not a court ruling.

AP also reported that Wexner’s legal representative said prosecutors had informed Wexner he was “neither a coconspirator nor target in any respect,” and that Wexner had cooperated. This is the representative’s account as reported by AP, not a judicial finding or a blanket determination about every aspect of the investigation.

What the subpoena does—and does not—mean

A congressional subpoena compels testimony for an inquiry. Here, the record establishes committee authorization, later formal issuance, and Wexner’s subsequent deposition. None of those steps alone proves criminal conduct, resolves disputed accounts, or establishes civil liability. The committee’s actions, Wexner’s statements, Garcia’s description of the testimony, and AP’s reporting on released records should be read as separate parts of the record.
