Larry David Says He Wishes He Could Join Lawsuit Over His FTX Super Bowl Ad

Larry David said he lost money from crypto compensation for FTX’s Super Bowl ad and joked he wished he could join the class action. He was not saying he had become a plaintiff.

Larry David said he wished he could join the class action over FTX because part of his compensation for the exchange’s Super Bowl ad was paid in cryptocurrency—and he says he lost money when FTX collapsed. He was joking about his own losses, not announcing that he had become a plaintiff. Separately, investors had sued David and other FTX promoters; a May 2025 court order let certain claims against him proceed past a dismissal stage but did not decide that he was liable.

What Larry David said about the FTX ad

In an Associated Press interview reported by CBS News on January 31, 2024, David reflected on appearing in FTX’s 2022 Super Bowl commercial. He said he had asked friends who knew about the subject whether taking the job was a good idea. After they reassured him, he recalled, “So, like an idiot, I did it.” CBS News’ report of the interview places the remark in the context of his decision to do the commercial.

David also said he would love to be part of the class action because “part of my salary was in crypto” and “I lost a lot of money.” The comment described his reported compensation and personal loss; it did not mean he had joined the lawsuit as a plaintiff.

Why David was named in the lawsuit

FTX’s 2022 Super Bowl commercial cast David as a skeptic who rejects a series of inventions and ideas, then rejects FTX before the ad urges viewers not to miss the next big thing. The original class-action complaint described him as an FTX brand ambassador and alleged that the commercial promoted the exchange. The case docket includes the complaint.

Those statements are allegations made by plaintiffs, not court findings. Being named in a complaint does not itself establish that David knew of FTX’s fraud or caused investors’ losses. His remark about wishing he could join the suit is also distinct from the claims investors brought against him.

What the May 2025 court order decided—and what it did not

In an order dated May 7, 2025, the U.S. District Court for the Southern District of Florida addressed David’s request to dismiss remaining Florida and Oklahoma securities claims. The court found a ruling on those two counts premature at that stage. It also dismissed counts 2–12 and 14 of the corrected complaint without prejudice and granted leave to amend. The docket’s May 7 order states that the counts were dismissed without prejudice.

“Without prejudice” means those claims were dismissed in a way that allowed plaintiffs to amend their pleading; it is not a finding that David was liable. The order was a decision about the pleadings and arguments before the court, not a verdict on what David knew, whether he committed wrongdoing, or whether he would be liable after trial.

What is the latest verified case milestone?

A First Amended Administrative Class Action Complaint was entered on May 28, 2025. That filing is the latest verified milestone available here; it does not establish the case’s status after that date. The May 2025 order and the amended complaint should therefore be read as procedural developments, not as a final resolution of the claims against David.
