Those provisions later became part of the Public Authorities (Fraud, Error and Recovery) Act 2025, which received Royal Assent on 2 December 2025. The powers are not an unrestricted right for DWP staff to inspect claimants’ bank transactions: banks are to check specified benefit-linked accounts against eligibility indicators and report matches. The available official sources do not establish whether the provisions had commenced or whether DWP had issued notices by 8 October 2026.
What the DWP bank-check powers allow
The eligibility-verification provisions in the Public Authorities (Fraud, Error and Recovery) Act 2025 allow DWP to send an Eligibility Verification Notice to specified financial institutions. A bank checks its own data for accounts receiving a specified DWP benefit, and accounts linked to those accounts, against indicators based on that benefit’s eligibility rules. It must report matches to DWP. For Universal Credit, the department gives capital limits as an example of a possible indicator.
The government says the measure does not give DWP direct access to bank accounts or transaction histories. The explanatory notes state: “The powers will not give DWP direct access to any bank accounts, nor any transactional information such as information on how claimants spend their money.” The bank performs the matching; DWP receives limited information to decide whether further inquiry is warranted.
Which benefits are covered
DWP’s factsheet names Universal Credit, Pension Credit and Employment and Support Allowance as the specified benefits. Adding other benefits would require parliamentary debate and approval. The State Pension cannot be added through this power. The explanatory notes also describe using information to examine other benefits if an incorrect payment is identified.

What happens if a bank flags an account
A match is not, by itself, a decision that someone is ineligible or has been overpaid. It is information for DWP to consider when deciding whether to investigate further. DWP says: “A human will always be involved in any further inquiries or investigations, and any decision taken afterwards which may affect benefit awards or eligibility, as they are now.”
- DWP issues a notice: the notice goes to a specified financial institution and relates to accounts connected with specified benefit payments.
- The bank checks its own data: it compares relevant account information with indicators based on benefit eligibility rules.
- The bank reports matches: DWP receives limited information, not a feed of transaction-level spending data.
- DWP considers next steps: any further inquiry and any decision that could affect eligibility or an award involves a human, according to the department.
Why the Lords challenged the measure
The Lords’ scrutiny focused on the reach of checks and the safeguards around them, not only on whether DWP should ever verify financial eligibility. A key concern was how joint or linked accounts could bring other account holders into the process. Lord Palmer of Childs Hill supported amendments intended to limit scrutiny to claimant accounts and raised questions about joint accounts and other account holders. Those were concerns raised in parliamentary debate; they are not proof that every linked-account holder would be investigated or that a particular impact occurred.

The government’s stated case is that earlier identification of incorrect payments can reduce fraud, error and debt. Its design relies on banks performing limited matching against relevant indicators, followed by human consideration of any further inquiry. Critics’ privacy and proportionality concerns sit alongside those safeguards: whether the scope is suitably narrow, and whether the treatment of joint accounts and third parties is fair, remain central questions for scrutiny.
Amendments and final passage
At report stage in October 2025, the Lords agreed non-government amendments relating to the eligibility-verification powers, including stronger safeguards and independent reviews. The Commons Library records two non-government amendments on these powers and a separate agreed amendment concerning DWP officers’ use of reasonable force in search and seizure. Lords third reading took place on 23 October 2025. The bill then returned to the Commons and received Royal Assent on 2 December 2025. The provisions therefore should not be described as a bill still awaiting Lords action.

What the savings figures do—and do not—show
DWP estimated that the measure could save up to £940 million over five years, with the estimate validated by the Office for Budget Responsibility. It also forecast around £500 million in annual savings once fully rolled out and 50,000 to 100,000 overpayments identified each year at full rollout. These are forecasts, not recorded outcomes.
For context, the House of Lords Library briefing reports National Audit Office estimates of £9.7 billion in benefit-system overpayments in 2023/24 and at least £3 billion in public-sector money lost to fraud or error outside the tax and social-security systems that year. Those historical estimates describe the scale of reported losses; they are not sums this bank-check power is guaranteed to recover.

Has DWP started using the powers?
The Act’s Royal Assent date is established, but the cited official materials do not establish whether the eligibility-verification provisions had commenced or whether DWP had issued notices by 8 October 2026. Royal Assent alone is not evidence that the power was operational or being used. Readers should therefore distinguish the law’s enactment from its commencement and any actual use.

What benefit claimants should take away
- The measure is an eligibility-verification process, not a general power for DWP staff to browse all claimants’ transactions.
- Banks check accounts connected to specified benefit payments against relevant indicators and report matches; transaction information about spending is excluded in the government’s description.
- A flag does not itself establish ineligibility or an overpayment; DWP says human involvement is required in further inquiries and decisions affecting awards or eligibility.
- The Lords agreed amendments intended to strengthen safeguards and provide independent reviews, but the final Act’s passage does not settle whether the provisions were in force or operational by 8 October 2026.
