In most U.S. workplaces, there is no general federal right to listen to music while working, so an employer can often prohibit music or headphones through workplace policy. OSHA’s guidance on construction sites says there is no specific OSHA regulation banning headphones there, but that does not require an employer to allow them. Safety hazards, state or local rules, and a collective bargaining agreement may affect the answer.
What federal law says about music and headphones at work
OSHA’s September 6, 2019 interpretation addresses headphones on construction sites. It says, “There is no specific OSHA regulation that prohibits the use of headphones on a construction site.” OSHA adds that use “may be permissible at managerial discretion, unless such use creates or augments other hazards apart from noise.” Read OSHA’s construction-site interpretation.
This is construction-specific guidance about whether OSHA has a particular prohibition; it is not a general right to wear headphones, nor does it prevent an employer from setting a stricter policy. It also is not an endorsement of any headphones or music player.
Why your employer may restrict music for safety
Music or headphones can mask sounds workers need to hear, including moving equipment, heavy machinery, vehicle traffic, and warning signals. Whether listening creates a hazard depends on the job and worksite. OSHA separately requires employers to keep workplaces free from known safety and health hazards. OSHA’s worker-rights guidance explains that baseline.

A portable music player is not hearing protection. If your job requires hearing protection, listening to music does not replace it; OSHA’s construction interpretation treats hearing-protection requirements and music use separately.
What to check in your workplace
- Your employer’s policy: Review the handbook, safety rules, or supervisor instructions for rules about headphones, earbuds, speakers, or personal devices. OSHA’s construction guidance leaves room for managerial discretion.
- Your actual hazards: Consider whether you need to hear alarms, coworkers, vehicles, or equipment. A rule may be tied to safety even if music is allowed in other parts of the workplace.
- Your state’s OSHA requirements: Some states operate OSHA-approved State Plans that may have different or more stringent requirements. OSHA’s State Plans overview describes the distinction.
- State or local law and any collective bargaining agreement: These may affect a workplace-specific answer, but the federal guidance cited here does not resolve every jurisdiction or contract.
Can a music ban violate labor rights?
The National Labor Relations Act may matter if a workplace rule is applied in a way that interferes with employees acting together about working conditions. The NLRB says most private-sector employees, whether unionized or not, have rights to organize and act together, and it describes employer conduct that can unlawfully interfere with those rights. That does not make listening to music itself protected activity or automatically make a music ban unlawful. The relevant question would be whether the rule or its enforcement interferes with protected concerted activity in the circumstances.

What to do if you think a restriction is unsafe or unlawful
- Ask for the rule and its reason. Check the written policy and ask whether the restriction applies everywhere or only in hazardous areas.
- Raise a specific safety concern. Explain what sound you need to hear or what hazard you believe the rule creates. OSHA says workers may speak up about safety concerns and request an inspection; see OSHA’s worker-rights guidance.
- Check the rules that apply to your location and job. State-plan coverage, state or local law, and any collective bargaining agreement can change the analysis.
- Seek appropriate help if the issue persists. For a workplace-safety concern, consult OSHA or your state plan. If you believe a rule interferes with employees acting together over working conditions, consult the NLRB or a qualified labor-law professional.
