What Texas law says about sports bets
Texas Penal Code §47.02(a)(1) makes it an offense to “make[] a bet on the partial or final result of a game or contest or on the performance of a participant in a game or contest.” That language applies to ordinary bets on sports contests, including wagers on a game’s outcome or a player’s performance. Section 47.02(d) classifies an offense under the section as a Class C misdemeanor. The statute’s classification describes the offense; it does not make a wager permissible because it is small, informal, or placed through an app.

Does the private-place defense make a private sports bet legal?
Section 47.02 lists a defense when all of these conditions are met: the gambling takes place in a private place, no person receives an economic benefit other than personal winnings, and the chances and risks are equal apart from skill or luck. These are cumulative conditions for a statutory defense, not a general authorization for sports wagering.
- The location must qualify as a private place.
- No one may receive an economic benefit beyond personal winnings.
- The chances and risks must be equal, apart from the effects of skill or luck.
Because each condition matters, the defense should not be treated as a blanket exception for a betting pool, a sportsbook, or a wagering app. Whether a particular set of facts satisfies the statute is a legal question.

How horse and greyhound race wagering differs
Texas regulates pari-mutuel wagering on horse and greyhound races separately under Chapter 2027 of the Texas Occupations Code. That framework restricts wagers to authorized circumstances and locations. For example, the statute provides for wagering by a racetrack association within its enclosure and addresses wagers on live or simulcast races under specified provisions. It is a distinct race-wagering regime, not an exception that opens betting on football, basketball, baseball, or sports contests generally. See Texas Occupations Code Chapter 2027.
What about the Texas Lottery and sports-event games?
Texas Government Code §466.024 prohibits the lottery executive director or a lottery operator from establishing or operating a lottery game in which the winner is selected based on the outcome of a sports event. This is a restriction on lottery games, not permission for private sports betting. The provision appears in Texas Government Code §466.024.
