Why India’s Trade Minister Warned About E-Commerce Growth and Amazon’s Pricing

India’s Commerce Minister Piyush Goyal questioned the effects of fast e-commerce growth and Amazon’s reported losses, but his comments were not a legal finding.

On August 21, 2024, India’s Commerce and Industry Minister Piyush Goyal warned that rapid e-commerce growth could disrupt traditional small retailers and questioned whether Amazon’s reported losses indicated predatory pricing. Those were the minister’s concerns—not a regulator’s finding that Amazon had broken the law. Goyal also said e-commerce has a role, but that role should be considered cautiously.

What did Piyush Goyal say?

Goyal spoke at the launch of a Pahle India Foundation report on e-commerce’s impact on employment and consumer welfare. He questioned whether a rapid shift to online shopping could harm traditional retailers and cause wider social disruption.

“Are we going to cause huge, social disruption with this massive growth of e-commerce? I don’t see it as a matter of pride that half our market may become part of the e-commerce network 10 years from now; it is a matter of concern,” he said, according to TechCrunch’s August 21, 2024, event report.

The Press Information Bureau’s event release attributed to Goyal a reference to 100 million small retailers who should not be disrupted. That is the figure reported by the minister and the release, not an independently verified count.

Why did he call Amazon’s pricing “predatory”?

Goyal pointed to what he described as Amazon’s annual loss of Rs 6,000 crore ($715 million) and asked: “If you make Rs 6,000 crore ($715 million) loss a year, doesn’t it sound like predatory pricing to you?” TechCrunch reported the remark. The amount is the minister’s characterization in a rhetorical question, not an audited figure established here.

Predatory pricing is an allegation in this context, not a legal conclusion. The reported comments do not establish that Amazon was found to have priced unlawfully, nor do losses alone establish that a company has engaged in predatory pricing.

What rules govern foreign-invested e-commerce marketplaces in India?

A February 5, 2020, Ministry of Commerce and Industry summary of Press Note 2 of 2018 says foreign-invested e-commerce entities may operate under a marketplace model, subject to restrictions on inventory-based e-commerce. The distinction is between providing a platform for vendors and holding or controlling inventory in ways restricted by the policy.

  • Sale prices: The government summary says marketplace entities must not directly or indirectly influence the sale price of goods or services.
  • Vendor services: It says services provided to vendors must be fair and non-discriminatory, with a level playing field maintained.
  • Cashback: The summary also addresses cashback, requiring it to be fair and non-discriminatory.

These policy requirements explain why pricing practices can attract scrutiny. They do not, by themselves, show that Amazon or any other company violated the rules.

What did the government report about earlier allegations?

In its February 2020 release, the government said the Department for Promotion of Industry and Internal Trade had received representations alleging predatory pricing and excessive discounts. It also said the Competition Commission of India (CCI) had ordered an investigation involving Amazon Seller Services and Flipkart over allegations including exclusive arrangements, deep discounting and preferential listing.

An investigation is a procedural step, not proof of wrongdoing. That 2020 release describes the status reported at the time; it does not establish the investigation’s current status or a later regulatory finding.

Was Goyal arguing against e-commerce?

No. In the remarks reported by TechCrunch, Goyal said, “I am not wishing away e-commerce,” and added, “I don’t deny that e-commerce has a role, but we have to think very cautiously what that role is.” His position, as reported, was to question the pace and consequences of growth while recognizing a role for online commerce.

The concerns he raised point to a policy trade-off: online marketplaces can offer consumers access and pricing options, while a rapid shift in sales may affect small retailers. The cited reporting and government releases do not quantify those effects sufficiently to determine their overall scale.
