Section 45V Hydrogen Tax Credit Rules: Nuclear, Carbon Capture and the 2027 Deadline

Section 45V ties the clean-hydrogen credit to lifecycle emissions. Nuclear and carbon-capture routes may qualify under specific rules, but facilities must begin construction by the end of 2027 under the IRS’s stated cutoff.

Section 45V can reward U.S. producers of qualified clean hydrogen for each kilogram produced, with the amount tied to verified lifecycle emissions. Treasury’s 2025 final regulations clarified how some electricity—including certain nuclear power—and methane-based pathways with carbon capture may qualify. But the credit is not automatic: the rules depend on a project’s emissions, electricity and equipment history, and construction timing. The IRS says facilities that begin construction after 2027 are ineligible, a cutoff that narrows the investment window.

What are the hydrogen tax credit rules?

Section 45V is a federal production tax credit for qualified clean hydrogen. A facility’s applicable credit tier depends on its lifecycle greenhouse-gas emissions per kilogram of hydrogen—not on whether the project is labeled “green,” “pink” or “blue.” The statutory ceiling is 4 kilograms of carbon-dioxide equivalent (CO2e) per kilogram of hydrogen; emissions above that limit do not meet the clean-hydrogen threshold.

The credit is calculated on hydrogen produced at a qualified facility and is available for a 10-year period beginning when that facility is originally placed in service. The IRS’s 2025 Form 7210 instructions separately state that the credit is eliminated for facilities beginning construction after 2027. That construction-start cutoff does not mean every facility already operating loses its credit in 2027.

Emissions tiers and 2026 applicable amounts

The IRS’s 2026 applicable amounts vary by emissions tier. The table shows amounts for hydrogen produced during calendar year 2026; they are not a universal per-kilogram payment for every project.

These are the indexed 2026 amounts in IRS instructions, not project-specific credit determinations. A facility must qualify and establish its emissions tier; the amount a project can claim can also depend on prevailing-wage and apprenticeship requirements. The highest listed amount therefore should not be used as a default estimate for a startup’s project.

How emissions are accounted for

Treasury’s January 3, 2025 final-rule summary says the rules address hydrogen made with electricity from multiple sources, natural gas with carbon capture, renewable natural gas and coal mine methane. For electricity-based production, the rules apply safeguards intended to account for direct and significant indirect emissions. These include incrementality, deliverability and temporal matching requirements for electricity and Energy Attribute Certificates. Treasury describes a phase-in toward hourly matching and an hourly accounting option once hourly matching applies.

As a result, a developer cannot establish eligibility simply by purchasing renewable electricity certificates or naming a low-carbon power source. The project must satisfy the applicable accounting rules and support the lifecycle-emissions calculation. The specific treatment depends on the facility’s power sources and the rules applicable to its production.

Can nuclear power qualify for the hydrogen tax credit?

Yes, in specified circumstances. Treasury’s January 2025 explanation describes pathways under which electricity from certain nuclear plants can be treated as incremental for Section 45V accounting. These are conditional rules, not a general exemption for any hydrogen producer that buys nuclear electricity.

  • At-risk reactors: Electricity from a nuclear plant meeting specified bright-line indications of retirement risk and indications that the plant’s continued operation is co-dependent on hydrogen investment may be treated as incremental, up to 200 megawatts per qualifying reactor.
  • Qualifying state policies: Treasury said electricity from generators in states with qualifying robust greenhouse-gas caps paired with clean-electricity or renewable-portfolio standards may be treated as incremental. In its January 2025 announcement, Treasury identified Washington and California as meeting the criteria at that time.

The state examples reflect Treasury’s dated explanation, not a timeless eligibility list. Whether a particular plant and hydrogen project meet the conditions requires applying the rules to their facts.

A separate incentive may also be relevant to a nuclear plant: IRS final-regulation material notes that a qualifying reactor supplying electricity to a hydrogen facility may itself qualify for Section 45U if it meets that credit’s requirements. That is a potential credit for the reactor, not an automatic Section 45U benefit paid to the hydrogen producer.

Can hydrogen made with carbon capture qualify for 45V?

Potentially. Hydrogen produced by reforming methane and capturing and storing carbon can qualify if its lifecycle emissions meet Section 45V’s requirements. The production route is often called blue hydrogen, but the label alone says nothing conclusive about the project’s emissions tier.

Credit coordination matters when the facility uses carbon-capture equipment. IRS final-regulation material says Section 45V is not allowed for hydrogen produced at a qualified facility that includes carbon-capture equipment for which a Section 45Q credit has been allowed in the current or a prior year. The regulations describe an 80/20 rule treatment for qualifying replacement equipment where no new Section 45Q credit has been allowed. The result can depend on facility boundaries and the equipment’s ownership and credit history; carbon capture does not always disqualify a project, and 45V and 45Q cannot simply be assumed to stack.

Treasury’s final-rule summary also addresses certain renewable-natural-gas and fugitive-methane sources, including wastewater, animal manure, landfill gas and coal mine methane. Those feedstocks require lifecycle-emissions calculations and source-specific treatment; their use alone does not establish eligibility.

What is the 2027 deadline for the hydrogen tax credit?

The IRS’s 2025 Form 7210 instructions say Public Law 119-21 eliminates Section 45V for facilities that begin construction after 2027. The relevant deadline is therefore about when construction begins, not a blanket date when all credit payments stop. A qualifying facility can still have a 10-year credit period beginning on its original placed-in-service date, subject to the law and applicable requirements.

For a project team, the construction-start date and the placed-in-service date serve different purposes: the first determines whether the facility falls within the stated cutoff, while the second starts the credit period. The IRS instructions establish the cutoff as described for 2025; sponsors should confirm current IRS guidance before relying on a project schedule or tax position.

What the rules mean for hydrogen startups and investors

Treasury presented the January 2025 final regulations as a way to provide clarity and investment certainty. Deputy Secretary Wally Adeyemo said the rules incorporated feedback from companies planning investments, while Senior Advisor John Podesta said the revisions provided certainty hydrogen producers needed to keep projects moving. Treasury also reported considering roughly 30,000 public comments while developing the regulations. Those are statements about the agency’s aims and rulemaking process, not evidence that every startup gained certainty or that the rules caused investment or deployment.

For a developer or investor, the regulations clarify pathways but leave material project-level questions to resolve. Before treating the credit as part of a financing case, assess:

  • Emissions: What is the project’s verified lifecycle-emissions rate, and which tier does it support?
  • Electricity: Do the project’s power sources and any Energy Attribute Certificates meet the applicable incrementality, deliverability and temporal-matching rules? If relying on nuclear power, does the specific pathway’s condition apply?
  • Process and feedstock: Is the hydrogen made through electrolysis, methane reforming with carbon capture or a qualifying methane-source pathway, and how does that route affect the lifecycle calculation?
  • Credit interaction: Has Section 45Q been allowed for carbon-capture equipment included at the facility, and is a Section 48(a)(15) election under consideration?
  • Schedule and compliance: When will construction begin, when is the facility expected to be placed in service, and can the project satisfy applicable verification and wage-and-apprenticeship requirements?

The 2025 final regulations give project teams more specific rules to evaluate, but neither the credit tier nor eligibility can be inferred from a technology label or the agency’s announcement. A project’s tax treatment depends on its emissions evidence, physical and contractual arrangements, equipment history and dates; sponsors should obtain qualified tax advice for that analysis.
