The U.S. law that threatened TikTok with a ban remains in force, but the app was not shut down: TikTok finalized a U.S. joint-venture deal in January 2026, and Americans could continue using the same app. The deal was presented as a qualified divestiture under the law. ByteDance retained a stake, so questions about its continuing role remain.
Why U.S. authorities moved toward a TikTok ban
Congress enacted the Protecting Americans from Foreign Adversary Controlled Applications Act as part of P.L. 118-50. It required ByteDance to divest TikTok by January 19, 2025, or face restrictions on app-store distribution and internet hosting. The Supreme Court upheld the law in 2025, according to the Congressional Research Service.
The law also provides a route for a presidential determination that a transaction qualifies as a “qualified divestiture.” That distinction matters: the law’s sell-or-ban framework did not mean a ban was inevitable if a qualifying transaction could be completed.
What changed: a U.S. joint venture
In an executive order dated September 25, 2025, the White House described a proposed U.S.-based joint venture that would be majority U.S.-owned and controlled. The order set out a 120-day period of non-enforcement to allow the proposed transaction to be completed. The Associated Press reported on January 23, 2026, that TikTok had finalized agreements with investors including Oracle, Silver Lake, and MGX, and that the same app would remain available to American users.

The figures for TikTok’s U.S. audience differ by source and date: the White House’s September 25, 2025 executive order cited about 170 million Americans, while the Associated Press used more than 200 million in its January 23, 2026 report. They are not directly comparable trend figures without consistent underlying methodology.
What safeguards were announced
Executive Order 14352 described the administration’s rationale and the safeguards it said the arrangement would provide. These are stated terms and claims in the order, not independent audit findings.

- U.S. data: Sensitive U.S. user data would be stored in a cloud environment run by an American company.
- Algorithm and code: The U.S. operation would control the algorithms and code, with recommendation models using U.S. user data retrained and monitored.
- Content moderation: U.S. content-moderation decisions would be made by the U.S. operation.
- Security monitoring: Trusted security partners would monitor software updates, algorithms, and data flows.
What remains unresolved about ByteDance’s role
The joint venture changed the ownership and control arrangement, but did not eliminate every connection to ByteDance. The Congressional Research Service says ByteDance retained a 19.9% stake and owns the underlying algorithm intellectual property, which the U.S. operation is to license. Some members of Congress have raised questions about continued ties to China and possible influence.
The Associated Press also reported uncertainty about how ByteDance’s role in licensing the algorithm would fit with the law’s restriction on cooperation over recommendation algorithms. These are oversight questions and reported uncertainty—not established findings that safeguards failed or that the law was violated. As Georgetown law and technology professor Anupam Chander told the Associated Press on January 23, 2026: “Who controls TikTok in the U.S. has a lot of sway over what Americans see on the app.”

Federal work devices are a separate question
On July 16, 2026, the Justice Department’s Office of Legal Counsel concluded that the joint venture’s version of TikTok does not fall within the No TikTok on Government Devices Act’s prohibition. The opinion cited the venture’s independence from ByteDance, majority American ownership, and revisions to the recommendation algorithm and cybersecurity program.
That opinion addresses federal government technology; agencies may still set their own policies. It does not determine what every state government or private employer allows. Nor is it the same legal question as the nationwide sell-or-ban statute.

What TikTok users should take away
- The federal sell-or-ban law was upheld, but it permits a qualified-divestiture path.
- The Associated Press reported that the U.S. joint venture deal was finalized in January 2026 and the same app remained available to Americans.
- ByteDance still had a minority stake and an algorithm-licensing connection, leaving issues for lawmakers and observers to scrutinize.
