You generally cannot stop others from pursuing the same broad app idea. You can protect specific assets you create: original code and content, your app’s brand, a qualifying technical invention, and confidential information that you actively keep secret. Which rights are available—and when you must act—depends on the countries involved and the details of your app.
Can someone steal your app idea?
Someone may independently build an app with a similar purpose or concept. Copyright does not give you ownership of a bare idea, concept, system, or method. The U.S. Copyright Office puts it plainly: “Copyright does not protect ideas, concepts, systems, or methods of doing something.” U.S. Copyright Office: What Does Copyright Protect?
What may be protected is the original expression you create—such as code, text, artwork, or particular screen designs. That protection does not automatically extend to the underlying business concept or guarantee that another app with similar functionality infringes your rights. WIPO’s mobile-app intellectual-property overview treats protection as a set of decisions across an app’s conception, development, and commercialization, rather than a single right over the idea.
Match each app asset to the right kind of protection

Protect confidential information before you share it
Trade-secret protection is for information that has economic value because it is secret and that you protect with reasonable measures. A useful first step is to separate genuinely confidential material from general information about the app. Share only what a recipient needs, restrict access to sensitive files, and label confidential materials where appropriate.
- Use appropriate confidentiality agreements with employees, contractors, or business partners when confidential information will be shared.
- Limit document and system access to people who need it, and use sensible IT security.
- Keep track of what was shared, with whom, and under what agreement.
WIPO describes confidentiality agreements, controlled access, and IT security as trade-secret precautions in its trade-secrets guidance; the USPTO also explains the U.S. trade-secret framework in its Trade Secret Policy. These precautions are not a shield against someone who independently develops the same information or discovers it through lawful reverse engineering. Trade-secret rules also vary by country or region.

Use written agreements when hiring or collaborating
Before work begins, put the relationship in a signed written agreement. Address the project scope, confidentiality, deliverables, and who will own or receive rights to work created for the app. Do not assume that paying a developer or designer automatically gives you every right you expect; the effect of contract language depends on the jurisdiction and circumstances. WIPO’s mobile-app resource covers agreements across the app lifecycle, but there is no universal contractor clause that fits every country or project.
Keep records as the app takes shape
Preserve dated versions of source code, designs, written material, and other creative work, along with project records that help show how the work developed. Copyright does not require publication, but an organized development history can be useful evidence. A timestamp alone does not create an exclusive right over an idea.

Choose and protect the app’s name separately
A name or logo can function as a trademark when it identifies the source of goods or services. Search for potentially conflicting names before committing to a launch identity, then consider whether registration makes sense in the markets where you plan to operate. In the United States, a federal trademark registration can provide nationwide protection for the specified goods or services; it does not protect app functionality. Assess patent options before public disclosure
A patent is not a way to claim a general app concept. The USPTO says abstract ideas and mere ideas or suggestions cannot be patented, although some business methods may be patentable. A specific technical implementation may warrant review by a qualified patent professional, who can assess issues such as eligibility, novelty, filing strategy, timing, and costs. The USPTO’s Patent Essentials explains that patent laws differ among countries and warns that pre-filing publication bars patent rights in many foreign countries.

If patent protection may matter, get advice for the relevant markets before a public launch, demo, or detailed disclosure. Do not assume a disclosure rule or deadline in one country applies elsewhere.

Commercialization creates practical tasks beyond protecting your own work. Check licenses for third-party code and content, including open-source components, and keep track of the terms that apply. Monitor for actual copying of protected expression or brand confusion; a similar idea alone is not enough to establish that someone infringed your rights. - If the dispute concerns copied code, artwork, or text, identify the specific original expression at issue.
- If it concerns a name or logo, assess whether the use is likely to cause brand confusion in the relevant market.
- If confidential information was shared, review what was disclosed, the safeguards used, and any applicable agreement.
- If a patent may be relevant, consult qualified counsel about the claims, countries, and filing history.
Keep the legal limits in view
The U.S. sources cited here describe U.S. federal principles, while WIPO provides an international overview. They do not amount to a universal filing checklist. The answer for a particular app can depend on your country, the implementation, disclosure history, contributors, and signed agreements. Consult local IP counsel for filings, contracts, or an infringement dispute.
