How Many Hours Is a Part-Time Job? U.S. Rules Explained

There is no single federal hours cutoff for a part-time job. Employer policies, BLS statistics, ACA health-coverage rules and FLSA overtime use different standards.

In the United States, there is no single federal number of hours that makes a job part time. The Fair Labor Standards Act (FLSA) leaves the full-time or part-time label generally to the employer. Other numbers you may see—35, 30 and 40 hours—refer to separate statistical, health-coverage and overtime rules.

Why there is no universal part-time cutoff

The U.S. Department of Labor says the FLSA does not define full-time or part-time employment; the classification is generally determined by the employer. The label does not change how the FLSA applies to an employee. Department of Labor FLSA guidance

For a particular job, check the offer letter, employee handbook, written workplace policy and any applicable contract or collective bargaining agreement. State or local rules may also matter, so the federal answer alone may not settle every question about a specific worker or benefit.

What the 35-hour threshold means

The Bureau of Labor Statistics (BLS) classifies people who usually work fewer than 35 hours per week as part time in its Current Population Survey (CPS). BLS explicitly says this is a statistical definition, not a legal one. BLS CPS definitions

The measure is usual hours, not necessarily the hours in every individual week. Someone who usually works part time can work 35 or more hours in a particular survey week and still be classified as usually part time.

What the 30-hour threshold means

For the Affordable Care Act’s employer shared-responsibility provisions, the IRS treats an employee as full time for a calendar month if the employee averages at least 30 hours of service per week or has 130 hours of service during that month. Why 40 hours is a different threshold

For covered, nonexempt employees, the FLSA generally requires overtime pay of at least one and one-half times the regular rate for hours worked over 40 in a workweek. That is an overtime-pay rule, not a line separating part-time from full-time jobs. Department of Labor overtime guidance

How to interpret 30, 35 and 40 hours

What to check for a specific job

  • Find the employer’s written definition of part time and full time; do not assume a label based only on a weekly schedule.
  • For benefit eligibility, read the plan or policy terms and identify the rule that applies to that benefit.
  • Check any applicable state or local requirements, employment agreement, or collective bargaining agreement.
  • Keep overtime separate from classification: a part-time label does not itself answer whether overtime rules apply.
