It depends on your state and the type of tax. Three years is a common state audit period, but it is not universal: Minnesota, for example, generally allows 3½ years for individual income tax returns. The clock may start from the later of the return’s due date or filing date, and exceptions can extend the period or remove the usual limit altogether.
How to find the deadline for your return
Start with the state and tax type shown on the return or audit notice. Then check the current rule from that state’s revenue agency and identify the return’s due date, filing date, and any event that could change the deadline. A period described for individual income tax may not apply to sales, business, or other state taxes.
The examples below show why a general three-year rule is only a starting point. They are not a 50-state survey, and the rules cited are specific to the state and tax context described.

What date starts the clock?
In several of these examples, the period is measured from whichever is later: the return’s due date or the date it was filed. That means filing early does not necessarily make the audit window expire earlier than the due-date-based calculation. A late-filed return can also have a later starting point. The exact trigger depends on the state’s rule and the tax involved.

Keep the filed return and proof of filing so you can establish the relevant date. If you received an extension to file, check the state’s instructions for how that affects the due date used in the calculation; do not assume the federal and state calculations match.
When the usual period may not protect you
States may provide a longer period—or no usual time limit—for particular circumstances. The examples above include unfiled returns, fraud, and substantial income omissions. The thresholds and consequences are not interchangeable: Georgia’s more-than-25% omission rule, for example, is a Georgia rule, not a nationwide standard.

Other events can also affect timing. Minnesota says the limit may be extended in certain situations. Georgia describes a six-month extension after a qualifying refund claim filed near the end of its assessment period. Maine says the taxpayer may be asked to agree to an extension. Read any proposed agreement carefully; signing can change the time available to assess tax.
A state audit deadline is not the IRS deadline
The IRS usually has three years to assess federal tax, measured from the return’s due date (including extensions) or, for a late-filed return, the date it received the return, whichever is later. Federal exceptions include failure to file, an agreement extending the time, certain large income omissions, and fraud. If you have received a state audit notice
Do not rely on the audit-period calculation as your response deadline. A notice may set a separate deadline to provide records, respond to proposed changes, or appeal an assessment. Follow the dates and instructions on the notice, and verify the applicable state rule with the revenue agency. If the amount is significant or you dispute the state’s position, consider consulting a qualified tax professional familiar with that state.
