Yes, Temu is a real online marketplace—not an unverifiable storefront—but “legit” does not mean every listing is high-quality, every seller is dependable, or every purchase is risk-free. In the United States, Temu is operated by Whaleco, Inc. and launched its U.S. marketplace in 2022. It connects shoppers with independent sellers, manufacturers, merchandise partners, and brands.
Tariffs also do not automatically mean that every Temu item will double in price. However, the old assumption that packages under $800 automatically enter the U.S. duty-free is outdated. Since February 24, 2026, the de minimis treatment has been suspended for goods entering the United States from all countries, subject to specific exceptions, and an additional 10% import surcharge generally applies unless an exemption applies. The final effect on a particular product depends on its origin, classification, applicable trade measures, shipping method, and who absorbs the cost.
The short answer: Temu is legitimate, but the marketplace requires more caution than the low prices suggest
There are two separate questions behind “Is Temu legit?”
- Does Temu exist and process real orders? Yes. It is an operating marketplace with a U.S. business operator, a website, an app, customer support, payment processing, shipping, and a formal return policy.
- Will every purchase be safe, accurately described, well-made, promptly delivered, and easy to refund? No marketplace can promise that—and Temu’s seller model, complaint record, and enforcement history give shoppers reasons to check listings and policies carefully.
Temu itself does not manufacture or own every product shown on its platform. Like other marketplaces, it brings together third-party sellers and suppliers. That means the reliability of one order may not predict the reliability of another.

The most accurate conclusion is that Temu is a real marketplace with real consumer protections and real consumer risks. It is not accurate to call every Temu product a scam, counterfeit, or unsafe. It is equally inaccurate to treat the platform as if its bargain price eliminates the normal risks of buying from unfamiliar sellers.
Why Temu is a real business—but not the same as a single retailer
Temu launched its U.S. marketplace in 2022 and is operated in the United States by Whaleco, Inc., according to the Federal Trade Commission. Products can appear in ordinary search results, on the homepage, and inside gamified shopping features.
That structure matters. When you buy from a traditional retailer, the retailer usually controls more of the inventory, fulfillment process, product standards, and seller relationship. On Temu, the listing may come from an independent seller, manufacturer, merchandise partner, or brand. The platform facilitates the transaction, but the item’s quality, description, packaging, and after-sale experience can vary.
So “Temu is legit” should not be read as “every seller on Temu is trustworthy.” It means the platform is a genuine marketplace rather than a fake website that exists only to take payments and disappear.

FTC enforcement: a marketplace-disclosure issue, not proof that every product is fraudulent
Temu has a current FTC enforcement matter involving the INFORM Consumers Act, a law that requires online marketplaces to provide certain seller information and consumer-reporting mechanisms. The FTC case page lists the matter as pending, with civil action number 1:25-cv-12466 and a last-updated date of September 8, 2025.
The FTC said Temu agreed to pay a $2 million civil penalty to resolve allegations that it failed to provide required seller-identification information and adequate ways for consumers to report suspicious activity. The allegations included listings in gamified shopping features and telephone reporting channels. Because the FTC case page identifies the matter as pending, this should not be described as a final finding that every Temu item is counterfeit, unsafe, or fraudulent.
The practical takeaway is narrower but important: shoppers should have enough information to identify who is selling a product and enough access to report suspicious listings. The FTC’s allegations concern those marketplace obligations and the ability to avoid or report stolen, counterfeit, or unsafe goods—not a blanket determination about every Temu order. BBB status: not accredited, B rating, and thousands of complaints
Temu.com is not BBB Accredited. The BBB profile cited here lists a B rating and 6,096 complaints. BBB also cautions that complaint totals should be viewed in light of a company’s size and transaction volume.

Not being BBB Accredited does not by itself mean that a company is a scam. BBB says businesses are not required to seek accreditation, and non-accreditation alone is not a finding of fraud.

BBB’s October 2025 complaint analysis identified recurring categories involving:
- Product quality or products not matching expectations
- Shipping delays or packages not being received
- Difficulty reaching or resolving issues with customer service
- Confusion about returns and refunds
- Website usability problems
These are patterns in complaints, not independently verified findings about every order. Still, they are relevant to the financial decision: a low sticker price is less attractive if the item is unusable, arrives late, or takes time and documentation to get refunded. The BBB Temu profile provides the rating, accreditation status, complaint information, and BBB’s explanations.
Will tariffs ruin Temu’s low prices?
They may put upward pressure on some prices, but there is no verified rule that tariffs will automatically double every Temu price. The effect depends on the item and on how sellers, Temu, logistics providers, and any U.S. fulfillment channels divide or absorb the added cost.
The old $800 assumption is no longer reliable
Many older articles explain Temu’s low prices by pointing to the U.S. de minimis rule and packages valued below $800. That explanation is now stale.
According to U.S. Customs and Border Protection, effective February 24, 2026, goods entering the United States from all countries generally remain ineligible for the administrative de minimis exemption unless a specific exception applies. This is not a Temu-only change, and it is not limited to products from China. It applies based on the applicable U.S. import rules, regardless of country of origin, subject to stated exceptions.
The former $800 threshold was also misunderstood. It was an administrative duty-free treatment for qualifying low-value shipments—not a blanket exemption from every tax, regulation, or product-specific tariff.
There is also a 10% import surcharge
CBP states that beginning February 24, 2026, goods entering the United States are also subject to an additional 10% import surcharge unless specifically exempt. That surcharge is separate from ordinary product- and country-specific duties.

There is no single Temu tariff rate
The amount applicable to a particular product depends on several factors:

- The product’s country of origin
- Its tariff classification
- Product- and country-specific trade measures
- The method used to enter the shipment
- Whether a stated exception or exemption applies
The official reference for product-specific rates is the current Harmonized Tariff Schedule. The USITC lists 2026 HTS Revision 12 as published July 21, 2026. A headline saying “Temu tariffs are 10%” is therefore incomplete: the 10% surcharge may be one component, not necessarily the entire import cost.
What changed operationally at the border?
Shipments that previously would have qualified for de minimis generally must now be filed using an appropriate entry type in U.S. Customs and Border Protection’s Automated Commercial Environment (ACE). International-mail shipments continue under separate carrier collection and remittance procedures.
Most shoppers will not personally file an ACE entry. The relevant point is that low-value international packages are no longer automatically outside the ordinary import process simply because their declared value is below $800. The seller, carrier, logistics provider, or importer may handle the entry and collection mechanics, but the costs can still influence the price or delivery experience.
What shoppers should expect

The best answer to whether tariffs will “ruin” Temu’s prices is therefore conditional: some products may become materially less attractive, while others may remain inexpensive depending on their supply chain and the seller’s pricing decisions. Compare the final checkout total—not just the promotional price—with alternatives available from a domestic retailer.
Temu’s return and refund rules: the details that determine your real risk
A return policy can make a low-cost purchase more manageable, but only if you know the deadlines, exclusions, and refund method. Temu’s U.S. return policy was last updated April 28, 2026 PDT.
How to start a return or refund
For an account holder, use:
Your Orders → Return/Refund
Select the item or items and the reason for the request. If Temu does not require a physical return, select either a Temu credit balance or the original payment method, then choose Submit. The current button shown after selecting the reason is Next Step.
If you checked out without a Temu account, the policy says to select Save your Order in the Temu order email to begin the return.
When a physical return is required, the label paths are:
- Your Orders → All Orders → Print your return label and start return → Print return label
- Or Your Orders → Returns → Print return label
Deadlines and costs
- Most eligible products can be returned within 90 days of purchase.
- Most electronics have a seller-dependent return window of 45, 60, or 90 days. Do not assume that every electronic item automatically has 90 days.
- After filing a return, the package must be postmarked within 14 days or the return process terminates.
- The first return of one or more returnable items from each order is free within the applicable return window, subject to exceptions.
- A pickup return may involve an additional fee.
- A second or subsequent return from the same order costs $7.99 plus applicable tax, deducted from the refund under the policy.
- Oversized, overweight, or remote-area returns may require you to pay shipping upfront and request reimbursement after inspection.
Items that may not qualify
Exceptions include worn, washed, or damaged clothing; grocery and food products; certain health and personal-care products; some free gifts; customized products; some underwear orders; and seller-designated nonreturnable products. Check the item-specific policy before buying, especially when the product is inexpensive enough that return shipping or a denied refund would erase the savings.

How refunds can be reduced or denied
A return can fail or result in a reduced refund if the item is used or damaged, parts or accessories are missing, or the item is damaged by improper packaging and the issue was not caused by Temu or the seller. Photograph the item, packaging, accessories, and shipping label before sending back anything expensive or easy to dispute.

For returned goods, Temu says the refund is processed after receipt and quality inspection. The policy says a refund can take 5–14 business days and, in some cases, up to 30 days to reach the original payment method.
Original shipping fees and import taxes are generally not refundable when the return is not caused by Temu’s or the seller’s fault. That means a return can be “free” in postage terms while still leaving some costs unrecovered.
Credits, advance refunds, and instant refunds
Temu may offer an advance refund after drop-off or an instant refund before the item is returned. These options are discretionary. If the item is not returned or fails inspection, Temu may charge the amount back to the original payment method.
Temu credits generally do not expire and are usually faster than a refund to the original payment method. They generally cannot be redeemed for cash and usually cannot be reversed after processing. Choose the original payment method if you are finished shopping on Temu and want money returned rather than a balance that encourages another purchase.

- If an order is marked delivered but you did not receive it, open the corresponding order in the Support Center and choose package shows delivered but not received.
- If an order is missing an item or part, choose missing item/parts.
- For an iPhone return, the device’s serial number must match the serial number on the original order. A mismatch results in a denied refund request under the policy.

A website can be a legitimate marketplace and still collect a substantial amount of personal information. Temu’s U.S. privacy policy, last updated November 14, 2025, identifies Whaleco Inc. as the company handling personal information through the Temu website and mobile app.
The policy says Temu may collect information such as:
- Account credentials and profile information
- Country or region
- Transaction history and product identifiers
- Payment information needed to complete a transaction
- Billing and shipping addresses
- Recipient contact details
- Customer-support communications
Those support communications may include text, images, video, audio, and supporting documents exchanged with a Temu agent or virtual assistant. Before uploading identification, photos, invoices, or other evidence to customer support, consider what the item requires and avoid sharing unrelated sensitive information. How to decide whether a Temu purchase is worth it
Use this checklist before placing an order:
- Calculate the delivered cost. Include shipping, taxes, any displayed import-related charges, and the possibility that a return may not recover original shipping or import taxes.
- Check the seller and listing details. Look at seller information, the exact size or quantity, materials, compatibility, included accessories, delivery estimate, and recent customer photos—not only the headline discount.
- Match the purchase to the consequences of failure. A small decorative item that disappoints may cost only time and a return. A product connected to health, safety, children, electricity, data security, or a costly device deserves substantially more scrutiny.
- Save evidence. Keep the listing, order confirmation, tracking details, seller information, and photos of what arrived. This is especially useful if the item is damaged, incomplete, materially different from the listing, or marked delivered but missing.
- Use the return deadline as a real deadline. Most eligible items have a 90-day window, but electronics can have 45, 60, or 90 days, and the package must be postmarked within 14 days after you file the return.
- Choose the refund destination deliberately. Temu credit may arrive faster but normally cannot be cashed out. The original payment method is preferable if you do not plan to shop there again.
- Compare alternatives after tariffs change. A domestic retailer may have a higher sticker price but a clearer seller relationship, faster delivery, easier returns, or no cross-border import uncertainty.
Who should be cautious—and when Temu may still make sense
Temu may still make financial sense for low-cost, non-urgent items when the final price is meaningfully below alternatives and you are comfortable with variable quality and the possibility of a time-consuming return. The calculation becomes less attractive when the item must arrive by a fixed date, must fit precisely, is difficult to inspect, has expensive return shipping, or would be costly or dangerous to replace.
Tariffs change that calculation at the margin. If the delivered price after import costs is close to a local retailer’s price, the cheaper marketplace may no longer offer enough savings to justify longer delivery, uncertain quality, or more complicated recourse. If the product remains substantially cheaper and the downside is limited, the purchase may still be reasonable.
Bottom line
Temu is not a fake storefront. It is a real U.S. marketplace operated by Whaleco, Inc., but it is a third-party seller platform rather than a guarantee that every product is reliable. The FTC’s pending INFORM Consumers Act matter and BBB’s complaint patterns are reasons to demand better seller information and to plan for quality, shipping, customer-service, and refund problems—not proof that every Temu order is fraudulent.
Tariffs are a genuine change to the low-price model. The former under-$800 de minimis assumption no longer generally applies, and a separate 10% import surcharge may apply, but the final price impact is product-specific. Do not assume all prices will double; compare the complete checkout total with a domestic alternative, and treat the return deadline and refund conditions as part of the price.

What should I do if Temu says my package was delivered but I did not get it?
Open the corresponding order in Temu’s Support Center and select “package shows delivered but not received.” For missing items or parts, select “missing item/parts.” Keep tracking information and order evidence in case support requests documentation.
The Bottom Line
Bottom line: Temu is legitimate as a marketplace, but not risk-free as a shopping experience. Its low prices may face pressure from the end of automatic de minimis treatment and the additional import surcharge, yet no evidence supports a universal doubling of prices. Judge each purchase by its final delivered cost, seller information, product risk, delivery needs, and realistic return options.
