The fourth federal safety probe reported in May 2024 concerned allegations that the automatic emergency braking (AEB) system in some 2023 Fisker Ocean vehicles applied the brakes without an apparent roadway obstruction. NHTSA opened a preliminary evaluation to investigate the reports; opening an investigation did not establish that a defect existed.
Why did NHTSA investigate the Fisker Ocean?
NHTSA’s Office of Defects Investigation (ODI) opened preliminary evaluation PE24013 on May 8, 2024, to examine reports of inadvertent AEB activation in model-year 2023 Fisker Oceans. The agency said it was investigating to determine the potential problem’s scope and severity and assess possible safety issues. NHTSA ODI’s opening resume describes braking that could occur without apparent obstruction and without adequate warning or driver input.
The resume states: “The braking applications range from momentary, partial application resulting in rapid loss of speed to full application, which brings the vehicle to a complete stop in the travel lane.” That describes the allegations ODI was evaluating, not a finding that the vehicles had a confirmed defect.
What did the opening investigation record count?
ODI’s 2024 opening resume recorded eight complaints, one injury incident and one injury. It listed no crashes or fires, and estimated a potentially affected population of 6,813 model-year 2023 vehicles. These are case counts and an estimated population, not a failure rate or an estimate of the likelihood that an Ocean would brake unexpectedly.

Sean O’Kane’s May 10, 2024, TechCrunch report said three of the eight complaints involved reported injuries. That account’s description differs from the official resume’s count of one injury incident and one injury; the two figures should not be treated as interchangeable.
Why was it called the fourth federal safety probe?
TechCrunch described PE24013 as the fourth investigation and identified three earlier probe topics: braking loss, vehicle rollaway and doors that would not open. “Fourth” refers to that reported sequence of investigations, not to a count of probes opened in 2026 or a claim that all four had the same evidence or outcome.

Was the AEB investigation a recall?
No. A preliminary evaluation is an investigation of reported safety concerns, not a recall or a final defect determination. NHTSA explains that consumer complaints can contribute to an investigation and that investigations may close after a recall recommendation or when a safety-related defect is not identified. A recall follows a determination by a manufacturer or NHTSA that a vehicle presents an unreasonable safety risk or fails minimum safety standards. NHTSA’s recall information explains the distinction and the types of remedies available.
Other Fisker Ocean recalls and safety campaigns should not be mistaken for the outcome of PE24013. Separate filings concerned brake-module software that could affect braking feel (campaign 24V623), electric water-pump failure that could trigger battery-power limitation (recall 24V-499), and instrument-cluster telltales (campaign 24V405). Their issues and remedies are separate from the AEB allegations.

What is known about the investigation’s later status?
A 2026 LegalClarity account says PE24013 closed in January 2025 because NHTSA lacked sufficient information after Fisker’s remaining staff were dismissed. It also says the closure was not a finding that no safety-related defect existed. The closure detail is attributed here to that account; the official opening resume does not document the later disposition.
