In an August 13, 2024 report, Ars Technica said Ireland’s Workplace Relations Commission (WRC) ruled that Twitter unfairly dismissed former senior executive Gary Rooney after he did not click “yes” in Elon Musk’s “A Fork in the Road” email. The award was reported as more than $600,000—not exactly $600,000—and the decision turned on the short deadline and whether silence could legally count as resignation.
What did Musk’s “A Fork in the Road” email ask employees to do?
In November 2022, after Musk took over Twitter, employees received an all-staff email asking those who wanted to stay to click “yes” by 5 p.m. Eastern Time the following day. Those who did not click were told they would receive three months’ severance. The email described the expected work as “extremely hardcore.”
As Ars Technica reproduced it, Musk wrote: “Going forward, to build a breakthrough Twitter 2.0 and succeed in an increasingly competitive world, we will need to be extremely hardcore.” He also wrote: “This will mean working long hours at high intensity. Only exceptional performance will constitute a passing grade.”
Why did Gary Rooney challenge his dismissal?
Rooney had worked at Twitter for nine years. He argued that his employment contract required resignation in writing, and that clicking “yes” did not explain what package or changes to his employment terms he would be accepting. The company’s position, as reported by Ars Technica, was that his conduct indicated resignation when he did not respond as requested.

WRC adjudication officer Michael MacNamee rejected the idea that not clicking the link could itself amount to a legal resignation and found the notice inadequate. Ars Technica reported that MacNamee wrote: “No employee when faced with such a situation could possibly be faulted for refusing to be compelled to give an open-ended unqualified assent to any of the proposals.”
How much was the award, and what did it cover?
Ars Technica reported the WRC award as more than $600,000. About $220,000 of it was for prospective future loss of earnings, according to the report. The WRC dismissed Rooney’s separate claim that he was owed a 2022 performance bonus.

The reported sum was described by other outlets as a record WRC award. These dollar figures are the amounts reported by Ars Technica in 2024; they should not be read as confirmation that Twitter paid the award or that the decision became final.
What happened to the other employees who did not click yes?
Twitter HR senior director Lauren Wegman testified that 35 of the 270 Ireland-based employees who received the email did not click yes, according to Ars Technica. That reported count does not establish that the other employees brought claims or received compensation.

Can an employer treat silence as resignation?
The reported ruling addressed Rooney’s circumstances, including his contract and the terms and deadline of the email. It distinguished the employer’s view that his conduct indicated resignation from the WRC’s conclusion that failing to click the link did not legally amount to resignation in this case. It is not a universal rule for every employer, contract, or country.

Ars Technica reported that Twitter could appeal the WRC decision to the Labour Court. That report does not establish whether an appeal was filed, whether the award was paid, or the case’s later procedural status. It also said Twitter had not commented by publication.
