What did Harbinger say Canoo left out?
In a limited objection filed March 28, 2025, Harbinger said information in the sale process—including the virtual data room and sale schedules—was incomplete. It alleged that some listed assets did not belong to the debtors and that other assets it believed they owned were missing. Harbinger specifically identified certain assets Canoo had acquired from Arrival Automotive UK Ltd. The filing does not provide a complete inventory, establish the disputed assets’ ownership or value, or show that a court found they were improperly withheld. Harbinger’s objection
Harbinger also challenged the sale process. It argued that the proposed buyer, WHS Energy Solutions, was an insider-affiliated bidder and that the offer was accepted without broad marketing or an appraisal. Harbinger said the data room did not let it independently value the trade-secret assets. Those statements were Harbinger’s allegations in an adversarial filing, not findings by the bankruptcy court.
Who bought the assets, and what was included?
The Chapter 7 trustee sought approval of an asset purchase agreement with WHS Energy Solutions. The District of Delaware later described WHS as an affiliate of Canoo’s former chief executive, Anthony Aquila. Under the agreement, WHS was entitled to 10% of the net cash recovery from the Harbinger litigation, after specified litigation fees and costs; the estates were to receive the balance. Harbinger did not object to WHS receiving that 10% share, but it challenged a different term: the agreement required the trustee and buyer to mutually consent to a settlement. The bankruptcy court approved the sale on April 9, 2025, and it closed two days later. Harbinger appealed. On March 17, 2026, the U.S. District Court for the District of Delaware affirmed the sale order, concluding that the bankruptcy court did not err in approving the agreement. That ruling addressed the sale and the settlement-consent dispute; it was not a factual determination that Canoo did or did not conceal physical assets. District Court memorandum opinion

The District Court said the trustee realized more than $17 million for the estates through the sale and characterized any additional litigation recovery as uncertain. A public bankruptcy docket tracker reports that on August 18, 2026, the court approved a settlement between the trustee and Harbinger defendants and allowed the agreement to be filed under seal. The tracker does not state the settlement terms or any payment.
