What BrightSource was proposing
BrightSource was developing Ivanpah, a three-plant concentrating solar thermal project on 3,600 acres in California’s Mojave Desert. In its 2011 SEC registration statement, the company described the project as having 392 megawatts of gross capacity. Why the tortoise issue threatened the schedule
During construction, government estimates indicated substantially more desert tortoises in the project area than earlier estimates had suggested. The Bureau of Land Management assessment, as reported by the Los Angeles Times, estimated that more than 3,000 acres of tortoise habitat would eventually be lost, that more than 160 adult tortoises would need to be captured and moved, and that the project could result in 600 tortoise deaths. These were agency estimates reported at the time, not confirmed final outcomes.

In April 2011, federal officials suspended construction activity on most of Ivanpah while a revised biological assessment was prepared. That created schedule risk for a project under development: more review and mitigation could affect when construction resumed and when the project could be completed. For a company seeking public investment, a delay can make the business plan and timing less certain, even when the underlying project remains viable.
What BrightSource said, and what regulators later decided
BrightSource disputed the tortoise estimates. Company spokesman Keely Wachs told the Los Angeles Times: “These are not consistent with the actual numbers of tortoise found on the project site. It appears that the largest concentrations of tortoise are outside the project and in areas that we designed the project to avoid.” That was the company’s position, distinct from the government estimates.

In June 2011, Forbes reported that the Fish and Wildlife Service’s revised biological opinion found Ivanpah would not jeopardize the continued existence of the desert tortoise and allowed construction to proceed. The decision did not erase long-term obligations or every ecological concern; Forbes described continuing tortoise responsibilities and unresolved environmental issues. Forbes, June 2011
How environmental obligations fit into the project
The dispute was not simply a choice between building a solar plant and protecting wildlife. The Center for Biological Diversity said a 2010 settlement with BrightSource included additional protections for desert tortoises and other rare species. A 2013 Stanford Graduate School of Business case study framed Ivanpah as a broader conflict among habitat protection, renewable-electricity generation, technology economics, and investor support for thermal storage. The project’s financing question therefore involved more than a single species count: investors also had to weigh construction and regulatory uncertainty against the case for utility-scale solar generation. What the dust reference does—and does not—establish
The sources available for this account do not establish a specific dust incident, measurement, construction delay, or health effect at Ivanpah. It would be inaccurate to attribute a dust-related problem to the project as fact on this evidence. The documented controversy was the tortoise-related review and its schedule implications.

What can be concluded about the IPO
The evidence establishes that BrightSource filed IPO paperwork in April 2011, with a proposed $250 million raise reported by the Los Angeles Times, while a tortoise review had interrupted most construction. It does not establish that the environmental dispute alone determined the offering’s outcome, or verify here whether the offering was completed. The defensible conclusion is narrower: the tortoise findings and regulatory review added visible project and schedule risk at a sensitive point for BrightSource’s proposed public offering.
