Senate Vote to Bring Whole Milk Back to Schools: What the Law Now Allows

The Whole Milk for Healthy Kids Act became law on January 14, 2026, allowing participating schools to offer whole milk as one option under federal school meal rules.

Yes. The Senate unanimously passed the Whole Milk for Healthy Kids Act of 2025 on November 20, 2025. The House passed it on December 15, and it became law on January 14, 2026. The law lets participating schools offer whole milk, but it does not require them to serve it.

What happened to the Whole Milk for Healthy Kids Act?

The Senate’s November 20, 2025 vote was an early step, not the final change in school meal rules. Congress later completed action on S. 222, and Presidentially enacted Public Law 119–69 took effect as the law governing the new permissions.

What does the law allow schools to serve?

For participating schools, the amended National School Lunch Program rules require them to “shall offer students a variety of fluid milk.” Among the options they may serve are flavored or unflavored, organic or nonorganic whole, reduced-fat, low-fat and fat-free milk, as well as lactose-free milk. The law also permits qualifying nondairy beverages that meet federal nutritional standards. Public Law 119–69, Section 2.

The distinction is between offering a variety and choosing a particular variety. The law permits a school to include whole milk; it does not direct every school to select or serve whole milk. Whether a student sees it on a cafeteria menu depends on the school’s choices.

How does this change the previous school milk rules?

Whole milk had been excluded from federally funded National School Lunch Program meals beginning in school year 2011–2012, after federal policy changes limited program milk to low-fat and fat-free varieties. The 2026 law amends those program rules to include whole milk as an allowable option. Congressional Research Service background; Public Law 119–69.

What other provisions are included?

  • Meal saturated-fat calculation: Milk fat is not counted as saturated fat for the specified calculation of a meal’s average saturated-fat content. Public Law 119–69.
  • Milk substitutions: For a student whose disability restricts their diet, the required written statement supporting a milk substitution may be provided by a parent or legal guardian, as well as by a physician. Public Law 119–69.
  • Food-allergy training: The law includes a food-allergy training provision for local food-service personnel. Public Law 119–69; House action record.

What the Senate vote does—and does not—tell families

The vote and enacted text establish a change in what participating schools may offer. They do not establish how many schools will add whole milk, whether students will drink more of it, or what effect the policy will have on health or dairy sales. Those outcomes are not measured by the legislative action or statutory provisions cited here.
