As of August 9, 2026, TikTok is still available in the United States—but its U.S. business now operates under a new ownership and control structure. TikTok USDS Joint Venture LLC was established on January 23, 2026, as a majority-American-owned company responsible for the U.S. TikTok operation.
For users, creators, advertisers, and small businesses, this is more than a change in paperwork. The arrangement affects who controls U.S. user data, recommendation systems, content moderation, and software security. It also changes how the federal government treats TikTok on government devices.
The U.S. did not buy TikTok outright
The deal is not a purchase of the entire global TikTok platform, and ByteDance has not been removed completely from the ownership structure.
Instead, TikTok’s U.S. operations are controlled by TikTok USDS Joint Venture LLC. The ownership is divided among American and international investors:

The structure keeps ByteDance below the 20% ownership threshold specified in the law and is intended to remove foreign-adversary control over the U.S. application. The White House classified the proposed arrangement as a “qualified divestiture” in a September 25, 2025 order.
Who controls TikTok USDS?
TikTok USDS is governed by a seven-member board with a majority of American members. TikTok CEO Shou Chew retains one board seat for ByteDance, but ByteDance is excluded from the venture’s security committee.
The operating executives identified by the venture are:
- Adam Presser, chief executive officer
- Will Farrell, chief security officer
That governance structure is designed to put U.S. security and operational decisions in the hands of the joint venture rather than ByteDance’s broader global organization.

U.S. user data is supposed to be protected in Oracle’s secure U.S. cloud environment. The venture also says its U.S. recommendation algorithm will be retrained, tested, and updated using U.S. user data.
That distinction matters because the deal is often described inaccurately as an American purchase of TikTok’s “original algorithm.” The public description is different: TikTok USDS is responsible for a U.S.-controlled recommendation system involving retraining, testing, monitoring, and software controls. The underlying technical architecture and complete source-code audit record have not been publicly disclosed.
Will TikTok still feel like the same app?
Probably not in the sense of becoming a completely separate American service. The U.S. version is intended to remain interoperable with the global TikTok platform.
TikTok’s global U.S. entities continue to handle or support functions including:
- E-commerce
- Advertising
- Marketing
- Global product interoperability
U.S. users are therefore expected to continue seeing content from around the world. Creators can still reach international audiences, and businesses can continue using TikTok’s advertising and commerce tools, subject to any future changes made by the joint venture or the global platform.

What this means for creators and small businesses
The deal does not automatically cancel creator accounts, remove existing videos, or end TikTok advertising in the United States. The app remains available, and the commercial functions used by creators and businesses continue to operate.
However, the ownership change creates several practical uncertainties:
- Recommendation changes: A retrained U.S. recommendation model could eventually affect which videos receive distribution, although no universal change to reach or monetization has been announced.
- Advertising operations: Advertising and marketing remain connected to TikTok’s global entities, so the joint venture is not the sole company involved in every commercial transaction.
- Commerce: TikTok Shop and other e-commerce functions are not described as fully detached from the global TikTok organization.
- Business continuity: Businesses that rely heavily on TikTok should continue maintaining email lists, websites, customer records, and other marketing channels rather than treating the app as their only source of customers.
These are planning considerations, not an announcement that creators will lose access or that business tools are being discontinued.
CapCut and Lemon8 are included too
The safeguards described for the joint venture also cover CapCut, Lemon8, and other apps and websites operated in the United States. That makes the arrangement relevant to people who use CapCut for video production or Lemon8 for publishing and audience-building, not only to TikTok users.
Can TikTok now be used on federal government devices?
On July 16, 2026, the Justice Department’s Office of Legal Counsel issued an opinion concluding that the No TikTok on Government Devices Act does not prohibit the version of TikTok operated by TikTok USDS.

The opinion relied on the view that TikTok USDS:
- Operates independently of ByteDance
- Is majority-owned by American investors
- Has revised the recommendation algorithm and cybersecurity program originally developed by ByteDance
This is a narrower development than a government-wide instruction to install or permit TikTok. The opinion addresses the federal statute. Individual agencies may still maintain stricter internal device, network, or cybersecurity policies.

What remains unclear?
The joint venture is operating, but the public record does not answer every question about how the arrangement works in practice.
- Congress has questioned how the security safeguards will be independently verified.
- The public materials do not spell out every restriction attached to ByteDance’s remaining 19.9% interest.
- TikTok USDS describes algorithm retraining and monitoring without publishing the full technical architecture.
- The venture has released security and community-guidelines information, but the public disclosures do not include every detail of the underlying agreements.
Those gaps do not mean the deal has failed. They mean that ownership percentages alone cannot prove how much practical influence each party has over data systems, software updates, moderation, or commercial operations.
What should TikTok users do now?
- Do not assume the app has been sold to the U.S. government. The U.S. operation belongs to a private joint venture, not the federal government.
- Review your account security. Use a unique password, enable available two-step verification, and be cautious about third-party services requesting TikTok access.
- Creators should keep backups. Save original video files, business records, tax documents, and important audience contacts outside TikTok.
- Businesses should diversify. Keep a website, email list, and at least one additional customer-acquisition channel.
- Watch official notices. Changes to privacy policies, advertising terms, commerce rules, or monetization programs may matter more to your finances than the ownership announcement itself.

Did the U.S. government buy TikTok?
