DHS Sought User Data From Tech Companies in Cases Involving Trump and ICE Critics

Reports describe DHS administrative subpoenas seeking identifying information tied to accounts criticizing immigration policy or documenting ICE activity. Some requests were challenged or withdrawn, while companies reportedly complied with others.

Reports published in 2026 say the Department of Homeland Security (DHS), including Immigration and Customs Enforcement (ICE), used administrative subpoenas to seek identifying information about people behind accounts critical of the Trump administration or documenting ICE activity. Google, Meta, Reddit and Discord were among the companies named in reporting. Some requests were challenged or withdrawn; reports also say companies complied with some requests. The public record does not show that every company disclosed data or establish a final court ruling that the subpoena effort was unconstitutional.

What DHS reportedly asked companies to provide

The requests sought information that could connect pseudonymous or anonymous accounts to real people. The reported targets included accounts criticizing immigration policy, sharing information about ICE activity, or offering immigrant-rights resources. The requested data varied by case: reports describe account-identifying information, and in one case personal and financial information. The reporting does not establish that every request sought message content.

“Unmasking” an account means linking it to identifying records such as a name, email address, phone number, address, payment information or account-registration details. A pseudonym is not the same as legal anonymity: a platform may hold records that identify the person behind an account.

TechCrunch reported on February 14 that DHS had sent hundreds of subpoenas to Google, Meta, Reddit and Discord. That figure is attributed reporting, not a public, complete accounting of individual requests or proven abuses. A House Judiciary hearing document later cited reports of the subpoenas and some company compliance. TechCrunch’s February 14 report and the March 4 House hearing document do not provide a complete company-by-company disclosure record.

What an administrative subpoena is—and what it is not

An administrative subpoena is a demand issued by an agency under statutory authority; it is not a search warrant issued by a judge. In the reported cases, DHS officials cited authority under 8 U.S.C. § 1225(d) and 19 U.S.C. § 1509(a)(1). DHS Assistant Secretary Tricia McLaughlin described Homeland Security Investigations as having “broad administrative subpoena authority,” according to TechCrunch’s February 3 report.

That statutory authority does not, by itself, decide whether a particular demand was lawful, sufficiently specific, proportionate or constitutional. The controversy is partly about requests issued without a judge’s advance approval. Companies and affected users may challenge demands, and some reported cases involved legal opposition or withdrawal. So “no prior judicial approval” is more accurate than saying there was no possibility of court review.

Cases that brought the requests to light

MontCo Community Watch

DHS sought information from Meta about people behind Facebook and Instagram accounts associated with MontCo Community Watch, a Pennsylvania-based account sharing ICE activity and immigrant-rights resources. The account holder challenged the demand on First Amendment grounds with ACLU representation. Reporting says DHS later withdrew the subpoena or subpoenas; it does not establish that Meta handed over the requested information in this case. A Philadelphia-area retiree

The Washington Post reported that Google notified a 67-year-old retiree, identified as Jon, that DHS had sought information associated with his account. The request reportedly followed within hours of his sending a critical email to a Homeland Security attorney about the treatment of an Afghan asylum seeker. The timing prompted concern about possible retaliation, but timing alone does not establish motive. The government characterized the subpoena as part of a criminal investigation and did not publicly explain its specific investigative basis in the reporting. The Washington Post’s February 3 account describes the dispute.

A student journalist

TechCrunch reported on February 10 that Google provided ICE with personal and financial information about a student journalist. This is a distinct reported disclosure, not the same case as the retiree’s subpoena or the MontCo dispute. The TechCrunch report also covered an Electronic Frontier Foundation appeal to major technology companies to resist DHS administrative subpoenas that do not meet legal requirements.

Other anonymous accounts

Additional reporting described efforts to identify operators of anonymous Instagram accounts critical of the government or documenting ICE activity. The available public information does not describe every account, request, or outcome. “Hundreds” refers to requests reported by people familiar with them, rather than hundreds of fully documented public cases.

What companies’ responses show—and do not show

  • Google: Reporting says Google notified some users, challenged at least some requests, and complied with some others. The student-journalist case involved a reported disclosure of personal and financial information. Google has said it reviews legal demands and pushes back when they conflict with law or policy; these general statements do not resolve the outcome of every request.
  • Meta: DHS sought information about MontCo Community Watch accounts. The public reporting does not establish whether Meta disclosed information in that case.
  • Reddit and Discord: Later reporting named both as recipients of DHS subpoenas. The public record described here does not provide a complete account of each company’s requests, challenges or disclosures.
  • Other companies named by Congress: A February 2026 congressional inquiry addressed Apple, Snap, Microsoft, X, TikTok, AT&T, T-Mobile and Verizon, among others. Being contacted by Congress is not proof that a company received a subpoena or complied with one. The Washington Post’s March 2 report describes the broader scrutiny.

The distinction matters: a subpoena is a request or demand, not proof of disclosure. Reports indicate that some companies provided information in some cases, but the available public record does not establish how many requests each company received, how many it challenged or fulfilled, what was transferred in every instance, or how often users were notified.

The First Amendment dispute

Anonymous political speech can receive constitutional protection, but that protection is not absolute. The central question is whether DHS sought identifying records for a legitimate law-enforcement purpose or targeted people because of their viewpoint. Civil-liberties groups argue that demands aimed at anonymous accounts criticizing government policy can chill speech and violate the First Amendment. The EFF’s February 5 letter to technology companies sets out concerns about the subpoenas and calls on companies to resist demands that do not meet legal requirements.

DHS, in at least one reported case, described an investigation into people allegedly trying to impede immigration-enforcement operations and cited officer safety. That is the government’s stated rationale, not an established finding that the account holders committed crimes. Criticizing policy, publishing ICE sightings, organizing observers or sharing immigrant-rights information is not, on its own, proof of criminal conduct. The public material cited here does not establish a final court ruling that the subpoena effort systematically violated the First Amendment.

Why notice to users matters

A platform’s notice can give an affected person time to seek legal advice and contest a demand before information is disclosed. The retiree’s reported notification illustrates that opportunity. Notice is not guaranteed in every case: a company may sometimes delay it or face restrictions on disclosure. The material available here does not establish a uniform notice policy across platforms.

For people using pseudonymous accounts, practical privacy risks include account-recovery details, phone numbers, payment records and device or network information that may help connect an account to an identity. Deleting a post or account does not necessarily erase records a service has retained. These are general considerations, not claims about the records held by a particular company in any specific case.

What happened after the first reports

In February 2026, House Democrats on the Homeland Security Committee sent technology companies letters seeking information about DHS requests and company responses. The Washington Post reported on March 2 that lawmakers were examining how companies handled the demands. A House Judiciary hearing document dated March 4 also cited reporting that companies had received hundreds of subpoenas and that some had complied. These developments show congressional scrutiny, not a final legal determination. The letters are available from House Homeland Security Democrats.

A separate development came in May. Bloomberg Law reported that the Justice Department—not necessarily DHS in every instance—subpoenaed Reddit and X for names, addresses and banking information associated with at least two anonymous users who criticized immigration-enforcement tactics. Those reported DOJ requests should not be merged with the earlier DHS/ICE cases as though they were all one program. See Bloomberg Law’s May 28 report.
