It authorized a fund for eligible claims, and the reported final distribution was far smaller: about $4.8 million to slightly more than 5,000 people, with roughly $58.2 million returned to the Treasury, according to Government Executive’s 2026 account. The proposed settlement dates to 2022; its claim deadline was December 23, 2022, so it is not an open payment opportunity in 2026.
Whether it was “enough” depends on the standard. It was a potentially useful compromise for people able to document qualifying losses, but it was not a comprehensive remedy for the lasting exposure of highly sensitive information belonging to approximately 22 million people.
Why the OPM breach was different from an ordinary data leak
The Office of Personnel Management disclosed two major breaches in 2015 involving different kinds of records: federal personnel files, and background-investigation information connected with security-clearance applicants, employees, family members and associates. The court’s preliminary-approval order described approximately 22 million affected individuals. The records included Social Security numbers and other personal details, as well as information from background investigations and security-clearance forms. The court order and CSO’s account of the settlement describe the unusually sensitive scope.
Some information can be changed after exposure; much of this cannot. A person can replace a password, but not a fingerprint, past residence, family relationship or the fact that particular information appeared in a security investigation. That does not mean every affected person experienced financial fraud or that misuse is inevitable. It does mean the risk and personal consequences are difficult to measure using only receipts for expenses already incurred.

What the $63 million settlement actually provided
The agreement, signed May 5, 2022, established a capped claims fund: $60 million from OPM through the Treasury Judgment Fund and $3 million from Peraton, the contractor involved in the related breach. Settlement administration, notice costs and court-awarded attorneys’ fees were handled separately from that fund; named-plaintiff service awards came from Peraton’s contribution. The allocation is set out in the motion for preliminary settlement approval.
The agreement described a $700 minimum for a valid claim and reimbursement of qualifying losses up to a stated $10,000 maximum per claimant. If eligible claims exceeded the available fund, payments could be reduced proportionally. The $700 floor was not a guaranteed payment to everyone whose records were exposed: a person had to meet the settlement’s claim requirements. Who could qualify for money
The proposed class generally covered U.S. citizens and permanent residents whose information was compromised in the OPM or Peraton breaches and who incurred a qualifying loss or time after May 7, 2014. The settlement process focused on documented economic losses and related mitigation, not exposure alone.

- TEST THE CARD: Test the card is working at your local supermarket. At the self-service checkout machines, combine the card and a contactless card on the payment reader. Payment with the contactless card will be blocked and an error message should occur on the reader.
- Qualifying expenses could include paid credit monitoring, identity-theft protection or remediation services.
- Costs to access, freeze or unfreeze a credit report could qualify.
- Identity theft, efforts to mitigate it, other documented out-of-pocket losses and compensable time were among the covered claim categories.
- Claimants had to submit a valid claim and supporting documentation where required.
Someone who was notified of exposure but had no qualifying expense or compensable time was not automatically entitled to a cash payment. Nor did anxiety or privacy loss, without a qualifying claim under the agreement, necessarily produce a settlement check. People who relied on free OPM-provided monitoring might not have incurred a reimbursable monitoring cost. The categories and process appear in the settlement motion and settlement notice.

Remaining in the settlement meant releasing covered claims against the defendants arising from the same factual basis. A person who opted out could preserve the ability to pursue an individual case but would not receive settlement benefits. The agreement therefore offered a trade-off rather than a guaranteed full valuation of each person’s harm:

OPM and Peraton denied wrongdoing and settled without a court deciding liability. The settlement was not an admission that either defendant was legally responsible. The settlement announcement describes the parties’ positions.

What happened to the fund
Government Executive reported that the case closed in 2024, that approximately $4.8 million went to slightly more than 5,000 people, and that roughly $58.2 million was returned to the Treasury. These are reported figures, not an independently verified court-accounting statement here. Dividing the rounded $4.8 million by just over 5,000 recipients suggests an average near $960 per recipient, but that is only an approximate calculation, not a reported official average. Government Executive’s 2026 report provides the distribution figures.
The unused balance does not show that most people suffered no harm. It does show that the settlement’s claims mechanism converted only a small part of its authorized fund into payments. Possible explanations include narrow eligibility, lack of documented expenses, reliance on free monitoring, missed or misunderstood notice, and the difficulty of turning long-term exposure into legally compensable economic loss. The payout alone cannot establish that the administrator acted improperly or identify how much each factor mattered.

Conversely, the fact that few people received checks does not make the settlement adequate for those whose losses were hard to document or whose main harm was continuing exposure.

How OPM’s monitoring program fits in
Cash compensation and identity-protection services were separate responses. Government Executive reports that the initial OPM program offered three years of protection and up to $1 million in coverage; Congress later required an expansion to ten years and up to $5 million. The ten-year period began in 2015 and started expiring around 2025, with users receiving expiration notices. OPM did not extend the program, citing cost and low recent claims. The same report describes ID Experts, now IDX, contracts valued at about $340 million and up to $416 million; those are contract values or ceilings, not necessarily amounts fully paid.
Monitoring can alert users to some forms of misuse and may help with restoration, but it cannot make exposed information secret again or prevent every form of fraud. Its much higher reported contract value than the cash settlement complicates a simple comparison: it represents a different kind of response, aimed at detection and assistance rather than reimbursement of past qualifying losses.
The case that the settlement was enough
As a legal compromise, the settlement had a defensible rationale. Continued litigation carried uncertainty, expense and delay, and plaintiffs would have had to establish legally compensable harm and connect it to the breaches. The preliminary-approval order said the agreement avoided those risks and fell within the possible recovery range. That is evidence the court viewed the compromise as procedurally reasonable; it is not a finding that the agreement fully measured the real-world harm. For a claimant with a recognized, documented expense, a payment without individual litigation could be more useful than a theoretical chance of a larger award after years of legal proceedings. The arrangement also addressed claims that might otherwise have been difficult to prove one by one.
The case that it was not enough
- The breach exposed unusually sensitive personal and background-investigation information, while the cash process required qualifying losses rather than paying for exposure alone.
- Many people could face administrative burdens or long-term risk without a conventional, documented financial loss that fit the claims rules.
- Only a small fraction of the authorized fund was reportedly distributed, leaving the settlement with limited practical reach compared with the population affected.
- The settlement did not put a clear dollar value on permanent privacy loss, personal-security concerns or national-security implications.
- Because the defendants denied wrongdoing and the case settled without a liability finding, the agreement’s deterrent effect is debatable.
The strongest judgment is therefore conditional: the settlement may have been adequate as a narrow compromise for documented economic claims, but it was not a complete remedy for millions of people’s exposure to information that cannot realistically be replaced.
Is there still an OPM settlement claim to file?
No current $63 million offer or open claim period was identified as of August 18, 2026. The proposed notice set December 23, 2022, as the claim deadline, and Government Executive reports the case closed in 2024. This article is not announcing a new payment opportunity. Treat unsolicited messages claiming that the old settlement is open with caution, and do not provide personal or banking information through an unverified link.
