Dr. Emmanuel “Manny” Hostin, an orthopedic surgeon and the husband of The View cohost Sunny Hostin, was accused of participating in an insurance-fraud scheme—but the accusation was made in a civil lawsuit, not a criminal prosecution. The case ended without a trial or a court finding that he committed fraud.
What was Emmanuel Hostin accused of?
American Transit Insurance Company named Dr. Hostin and his practice, Hostin Orthopaedics & Sports Medicine, as defendants in a federal civil lawsuit filed in the Eastern District of New York on December 17, 2024. The case was American Transit Insurance Co. v. All City Family Healthcare Center Inc. et al., No. 1:24-cv-08606-JRC.
The complaint named nearly 200 defendants and alleged a broader scheme involving:
- Medically unnecessary treatment and surgeries;
- Fraudulent billing submitted to American Transit;
- Kickbacks or other improper compensation connected to ambulatory surgical centers; and
- Payments allegedly structured as dividends or distributions tied to an investment in Empire State ASC.
According to the complaint, Hostin provided arthroscopic surgeries through his medical practice and billed American Transit in connection with the alleged arrangement. Those statements were allegations made by the insurer. They were not established facts or a criminal conviction.

How much money was involved?
American Transit sought more than $153 million in compensatory damages. It also sought more than $459 million in treble damages under federal racketeering laws. Because of the potential treble-damages claim, media reports often described the lawsuit as a roughly $450 million case.
A damages request in a complaint is not the same as money awarded by a court. The amount represents what the plaintiff asked for and does not prove that the defendants owed that amount.
How did Hostin respond?
Hostin’s attorneys denied the allegations. Sunny Hostin described the lawsuit as a “frivolous civil lawsuit” and said American Transit was using her public profile to generate negative publicity. She also said the family was considering a counterclaim of approximately $5 million over what she characterized as defamatory allegations.

There was no criminal charge against Dr. Hostin identified in the available reporting about this case. The lawsuit was a civil action brought by an insurer seeking financial damages.
What happened to the lawsuit?
On July 8, 2025, American Transit filed a stipulation voluntarily dismissing Dr. Hostin and Hostin Orthopaedics & Sports Medicine from the case. Reports described the resolution as a settlement, but the financial terms were not publicly disclosed.
In a statement reported on July 10, American Transit said that Hostin had been included primarily because he held a small ownership interest in a surgical center involved in the dispute. The insurer said it withdrew the claims against him and his practice, agreed to pay invoices submitted by Hostin, and regretted public speculation involving Hostin, Sunny Hostin and their children.
The dismissal was reported as being with prejudice. In general, that means the same claims cannot be brought again against the dismissed party. It does not mean a judge conducted a trial and ruled on whether the original allegations were true.

Was Emmanuel Hostin found guilty of insurance fraud?
No. The available record and reporting do not show that Hostin was criminally charged, found guilty or held civilly liable for insurance fraud in this matter.
The most accurate description is that he was named in a civil insurance lawsuit, denied the allegations, and was later dismissed from the case with prejudice after an undisclosed resolution.
