Per leggere un assegno italiano, individua data e luogo di emissione, importo in cifre e in lettere, beneficiario e firma. Se i due importi non coincidono, la guida della Banca d’Italia indica come riferimento quello scritto in lettere. Questi controlli aiutano a interpretare il titolo, ma non garantiscono che la banca lo paghi.
Quali campi leggere su un assegno
La Banca d’Italia riassume le informazioni da compilare così: “Devi solo riportare negli spazi indicati la data e il luogo di emissione, la somma da pagare in lettere e in cifre, il beneficiario (la persona a cui devi fare il pagamento) e la tua firma.” (Banca d’Italia, L’economia per tutti: Assegno).
- Data e luogo: indicano quando e dove viene emesso il titolo. La data deve essere quella effettiva di emissione.
- Importo in cifre e in lettere: entrambi devono essere compilati. Se divergono, secondo la guida della Banca d’Italia prevale l’importo in lettere. Indicare anche i centesimi e delimitare la somma per rendere più difficile aggiungere cifre o parole.
- Beneficiario: è la persona o l’ente a cui è destinato il pagamento; controlla che il nome sia presente e leggibile.
- Firma: è l’ordine impartito alla banca. Chi emette l’assegno deve firmare nello spazio previsto, con una firma corrispondente a quella depositata presso la banca.
Quando compili, usa una penna con inchiostro indelebile, come consiglia la Banca d’Italia, e non scrivere nello spazio sottostante la firma: segni o annotazioni in quell’area possono ostacolare la lavorazione elettronica. (Banca d’Italia, L’economia per tutti: Assegno).
Che cosa significa “non trasferibile”
La clausola “non trasferibile” significa che l’assegno è pagabile soltanto al beneficiario indicato e non può essere ceduto a un’altra persona tramite girata. Per gli assegni bancari e postali di importo pari o superiore a 1.000 euro la clausola è obbligatoria, secondo le regole antiriciclaggio richiamate dalla Banca d’Italia. Gli assegni in forma libera sono ammessi sotto tale soglia su richiesta. La Banca d’Italia indica un’imposta di bollo di 1,50 euro per ciascun modulo libero; l’importo è riportato nella sua guida e non va confuso con l’anno del decreto antiriciclaggio citato per la soglia. Che cosa controllare quando ricevi un assegno
Prima di accettarlo, verifica che il titolo sia completo, che riporti beneficiario e firma e che non presenti abrasioni, correzioni o segni che rendano incerta la sua genuinità. La banca può rifiutare il pagamento se mancano informazioni o se rileva alterazioni. Per importi pari o superiori a 1.000 euro, controlla anche la presenza della clausola “non trasferibile”. Controlla la data
La data futura è una post-datazione: può indicare che chi ha emesso l’assegno conta di avere fondi in seguito, ma la Banca d’Italia avverte che post-datare è illecito e può essere sanzionato. Una data passata, invece, riduce il tempo utile per presentare l’assegno all’incasso. Presentalo o versalo tempestivamente e chiedi alla tua banca quali tempi si applicano al tuo caso. Un assegno è un ordine di pagamento, non una conferma che sul conto ci siano fondi sufficienti né che il titolo non sia stato revocato. Anche un assegno compilato correttamente può non essere pagato; carenze formali o alterazioni possono portare la banca a rifiutarlo. Per sapere l’esito, rivolgiti alla banca che riceve o presenta il titolo. (Banca d’Italia, L’economia per tutti: Assegno).
