Booking.com is covered by the EU’s Digital Markets Act (DMA) because the European Commission designated its parent, Booking Holdings Inc., a gatekeeper on 13 May 2024. The latest Commission update, dated 28 September 2026, says Booking.com no longer uses off-platform prices to decide potential eligibility for its Sponsored Benefit program and has added information for accommodation providers about partner programs and ranking. The update concerns properties in the European Economic Area (EEA); it is not a finding that Booking.com broke EU competition law.
What the EU designated—and when
The Commission designated Booking Holdings Inc. as a gatekeeper for Booking.com’s online intermediation service on 13 May 2024. It said the service met the relevant thresholds and was an important gateway for business users seeking to reach customers. The designation decision was based on information available when it was adopted and may be reconsidered or amended if relevant facts change or the decision relied on incomplete, incorrect or misleading information. Booking Holdings had to bring Booking.com into compliance with the relevant DMA obligations from 14 November 2024. The Commission’s compliance announcement identifies that date and the covered service.
Gatekeeper status is a regulatory designation under the DMA, not a determination that the company committed an infringement. The Act complements EU competition rules, which continue to apply. The Commission’s DMA overview explains the relationship between the two regimes.
What the September 2026 update says
In a factsheet published on 28 September 2026, the Commission described additional Booking.com measures following regulatory dialogue and feedback from the travel sector. It says contractual parity requirements were removed from Booking.com’s EEA General Delivery Terms, agreements and partner programs in July 2024. Sponsored Benefit eligibility and performance
Booking.com’s Booking Sponsored Benefit (BSB) program lowers the price displayed to a customer while the accommodation provider receives its set rate; the agreed commission remains unchanged. The Commission says external prices are no longer considered when deciding whether a property is potentially eligible for BSB. It also reports that providers receive more information about BSB performance, including more granular reservation-level data.
Partner programs and price information
The Commission says Booking.com now provides clearer explanations of the benefits, eligibility rules, performance scoring, geographic benchmarking and possible suspension associated with Genius, Preferred and Preferred Plus. It also says external price scans shown in the Extranet are informational, not inputs to default ranking or eligibility assessment for those named programs. The “competitive” and “non-competitive” labels have been removed from the Extranet.
Default ranking
The factsheet says the Partner Hub provides more information about default ranking, including that external prices are not an input. The Commission said this explanation was also expected to appear in an update to Booking.com’s General Delivery Terms later in 2026; that statement describes an expected update, not confirmation that it had already been published.

What the parity ban means for accommodation providers
The DMA prohibits parity requirements—and other measures with the same restrictive effect—for designated platforms such as Booking.com. In practical terms, accommodation providers active on Booking.com in the EEA can set different prices, availability, inventory or commercial conditions on their own websites and other channels. The Commission says Booking.com may not respond to an off-platform price difference by raising a provider’s commission or delisting its offer.
The Commission also describes obligations involving continuous access to data generated by businesses and customers, and transfer of business-user data to alternative platforms. These rules concern the platform’s treatment of business users; they do not mean every provider has identical contract terms or that every individual dispute is automatically resolved by the designation.

What this could mean for travelers—and what it does not prove
The Commission argues that direct bookings can reduce providers’ platform commissions and give them an incentive to lower prices or invest in service. It also says competition between platforms can improve service and lower prices over time. These are the Commission’s stated rationale and anticipated benefits, not independently measured outcomes established by the September 2026 factsheet. A provider’s actual prices, availability and booking conditions can still vary across channels.
National proceedings are separate
The Commission says the voluntary changes do not prejudice ongoing proceedings by national competition authorities, particularly in Greece, Italy and Spain, or by other competent national authorities. The update should not be read as resolving or ending those proceedings.
