Choose a U.S. crypto exchange by checking the exact legal entity and product you plan to use—not by relying on its brand name or a general claim that it is “regulated.” The right records depend on whether you are trading spot crypto, securities, or derivatives, and on your state. Even a valid registration or clean disciplinary record does not guarantee that a company is safe.
Start with the company and service you will actually use
Write down the exchange’s legal operating entity, your state, and the service involved. The entity that runs the app may differ from the affiliate that holds customer assets, executes trades, or offers derivatives. A parent company’s registration—or a platform’s brand name—does not by itself establish that the entity providing your specific service is authorized for it.
Separate the activities you intend to use: buying or selling crypto for immediate delivery (spot), trading a product that may be a security, or entering futures and other derivatives. One company may offer more than one of these, and the relevant checks can differ by service.
Match the product to the relevant regulator and record

These are different regulatory questions, not interchangeable badges. A FinCEN MSB listing, for example, does not establish SEC exchange registration or CFTC/NFA derivatives registration.

Consider the asset as well as the platform
Do not assume all tokens on one platform have the same legal status. The SEC’s March 17, 2026 interpretation and its educational page, published April 22 and reviewed or updated May 15, 2026, describe categories including digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. The SEC guide says some stablecoins may be securities depending on their features; a tokenized security represents a financial instrument that meets the legal definition of a security.
For the asset and transaction you are considering, check the latest SEC guidance rather than treating a platform-wide label as a classification of every listed token. The legal characterization can depend on the asset’s features and the transaction.

Search official records using the exact entity name
- Find the operator. Read the platform’s terms, disclosures, and account-opening documents to identify the legal entity that will serve you. Note relevant affiliates that custody assets, execute trades, or provide a separate product.
- Choose the checks that fit the service. For securities-related activity, consult the SEC’s active exchange and ATS lists and use Investor.gov and FINRA BrokerCheck for firms and relevant individuals. For derivatives, search NFA BASIC and the relevant CFTC/NFA records. For spot virtual currency, check FinCEN’s MSB search and NMLS, then consult your state regulator for applicable state status.
- Compare the result with the company’s claim. Confirm that the record names the entity and service you identified, rather than only a parent or unrelated affiliate. Note whether a statement is verified in an official public record or is only the company’s own claim.
- Ask about a mismatch or missing result. Ask the firm to identify the entity, service, registration category, and jurisdiction behind its claim. A missing search result alone does not prove wrongdoing: the firm may rely on an exemption or a differently named regulated entity. Verify that explanation rather than assuming it is correct.
Public records can change, as can the products and states a platform serves. Recheck them for the entity and service you intend to use before opening an account or making a decision.
Evaluate how the platform operates, not just its registrations
After checking applicable records, compare the features that affect your use of the service. The SEC recommends asking questions such as these:

- Do you trade securities on this platform?
- Does the platform operate as an ATS?
- How does the platform select digital assets for trading?
- What are the trading protocols, and how are prices set?
- What fees apply, and how do spreads affect the total cost?
- Does the platform hold users’ assets? If so, how are those assets safeguarded?
- What are the custody and withdrawal terms, and what safeguards protect personal and trading information?
- Which assets and services are available to residents of your state, and what support is available if a transaction or account issue arises?
An order book display or a marketing claim about listing standards does not prove that a platform operates as an SEC-registered exchange. Consider the actual trading rules, access, pricing, custody arrangements, and security practices rather than inferring them from the interface.
Understand what a clean record does not promise
The CFTC warns: “Registration and a clean disciplinary record won’t protect you from fraud.” A registration check can help establish whether a particular entity appears in a relevant public record; it is not a guarantee against loss, misconduct, operational problems, or fraud. Continue assessing the specific service and its risks after you complete the checks.

Keep the decision specific to your state, entity, and product
This is a general U.S. consumer framework, not a legal conclusion about any particular exchange. State status, service availability, licensing records, and agency interpretations can change. The relevant answer may differ for two customers using the same brand if they live in different states or use different products. Base your decision on current records for the precise entity and activity you plan to use.
