The bill would have moved the committee’s work to the Department of Agriculture and made livestock brand inspection voluntary. A separate measure, LB 1187, became law; it should not be mistaken for the failed restructuring proposal.
What does Nebraska’s Brand Committee do?
The Nebraska Brand Committee administers provisions of the state’s Livestock Brand Act. The law’s purpose is to protect livestock owners from theft through brand recording, inspection and investigation. It also establishes a Nebraska Brand Inspection and Theft Prevention Fund, supported by fees and other money collected under the act, to pay for administration and enforcement. As described in the Nebraska Examiner’s January 2026 report, inspections are mandatory for cattle owners in the western two-thirds of Nebraska. The committee verifies ownership in certain livestock transactions and movements. The specific requirements depend on the applicable law and circumstances; the Legislature’s current statutory text is the reference for those rules.
What did LB 1258 propose?
Introduced by Sen. Ben Hansen in January 2026, LB 1258 proposed eliminating the Brand Committee, transferring its responsibilities to the Department of Agriculture and making brand inspection voluntary. The proposal would have changed both who administered the system and whether inspection was required. It did not become law: the Legislature’s LB 1258 action history records the bill as indefinitely postponed on April 17, 2026.

Why did lawmakers disagree?
Supporters argued the system burdened producers
Hansen argued for a less burdensome approach, saying the existing system did not seem like “an efficient use of taxpayer dollars … or an efficient use of the producers’ time and their money,” according to the Nebraska Examiner. Sen. Teresa Ibach supported his proposal, describing it as a solution that “best serves Nebraska’s cattle producers” and saying it was time to act to protect the industry’s competitiveness and sustainability.
Critics emphasized proof of ownership and theft protection
Sen. Tanya Storer warned that “anything that degrades or erodes that basic provision for proof of ownership is not acceptable,” the Examiner reported. Her concern reflected the opposing view: mandatory inspection helps establish ownership and supports livestock-theft prevention. These are competing arguments about the effects of the proposed change, not findings that voluntary inspection would necessarily cause theft or that the existing system is free of problems.

Industry positions reported at the time were not final endorsements
The Examiner reported in January 2026 that the Nebraska Cattlemen planned to decide its stance and that the Nebraska Farm Bureau was reviewing the legislation. Those were descriptions of the groups’ positions at the time of publication, not confirmation of their current views.
What triggered the dispute over fees?
The proposal followed a controversy over inspection charges. The Examiner reported that the committee continued charging a $20 surcharge per inspection rather than calculating a fee based on inspectors’ actual miles traveled, despite a 2021 statutory change. Executive Director Don Arp told the newspaper that a flat fee was a more practical way to calculate costs. The report said the committee planned to begin using the mileage system after a complaint was filed with the Attorney General’s Office; that office declined to provide more information about the complaint.

This is the Examiner’s account of the committee’s charging practice, explanation and planned change. The reporting does not establish a final legal finding about the complaint. For the fee rules currently in force, consult Chapter 54 rather than assuming the proposed LB 1258 changes were adopted.
How is LB 1187 different from LB 1258?
LB 1187 was a separate bill that changed provisions of the Livestock Brand Act. It passed final reading on April 10, 2026, and the governor approved it on April 16, according to the Legislature’s LB 1187 action history. Chapter 54 includes amendments sourced to LB 1187, with operative dates specified by provision.

Its enactment does not mean Nebraska abolished the committee, transferred its duties to the Department of Agriculture or made inspections voluntary. Those were LB 1258’s proposed changes, and LB 1258 was indefinitely postponed. To determine a specific current requirement or fee, use the relevant provision of the current Chapter 54 text.

For cattle owners, the key distinction is between a bill that was proposed and a law that took effect. LB 1258 did not change the inspection system. The committee’s statutory responsibilities remain governed by the Livestock Brand Act as amended, including the separate changes enacted through LB 1187. The Nebraska Examiner also reported that livestock brings in more than $12 billion to the state’s economy annually, citing a Department of Agriculture brochure; the brochure’s publication year was not established, so that figure should not be read as a newly measured 2026 statistic.
