Brazil Tax Change Could Make U.S. Soybeans More Attractive—but the Effect Is Unproven

Brazil’s court upheld restrictions on public benefits for companies in certain sourcing agreements, but any resulting advantage for U.S. soy remains unmeasured.

A Mato Grosso law could weaken the business incentives behind a major voluntary soy-sourcing commitment, potentially affecting how buyers weigh Brazilian and U.S. soybeans. But the legal change is not a nationwide Brazilian tax increase, and available evidence does not show that buyers have shifted to U.S. supplies or that U.S. soy has become more competitive on price.

What changed in Brazil?

The change concerns Mato Grosso, one of Brazil’s major soybean-producing states—not Brazil as a whole. On August 12, 2026, Brazil’s Supreme Federal Court (STF) upheld state laws that restrict fiscal incentives and other public benefits for companies participating in certain agreements that limit agricultural expansion. The court considered Mato Grosso’s Law 12.709/2024 and a similar law from Rondônia. The STF’s summary of its decision describes the outcome.

The laws affect the benefits available to companies that join agreements; they do not themselves ban soybean farming. Nor did the court invalidate the private sourcing agreement at the center of the case. Its decision upheld both the agreement’s constitutionality and the states’ authority to restrict benefits for companies participating in similar commitments.

What is the Soy Moratorium?

Created in 2006, the Soy Moratorium is a voluntary commitment by companies not to buy soy produced on land in the Amazon biome that was deforested after July 2008. It is a sourcing rule adopted by participating companies, not a government-wide prohibition on soy production. The STF’s account of the case describes the agreement’s origin and scope.

The distinction matters: the state laws address public benefits for companies that take part in certain agreements, while the Moratorium sets a private purchasing commitment. A ruling that validates a restriction on public benefits does not, by itself, establish how any particular company will source soy or whether it will continue participating.

When do the tax-related provisions take effect?

The court records qualify the timing of the laws’ tax provisions. They take effect only after the applicable constitutional notice period, and the court said the rules must respect Súmula 544, which concerns tax exemptions granted subject to an onerous condition. Consequently, it would be inaccurate to say that every affected tax incentive disappeared immediately upon the court’s decision. The qualifications appear in the STF’s official records for ADI 7774 and ADI 7775.

How could this affect U.S. soybean competitiveness?

The possible chain of effects is indirect. If companies receive fewer public benefits for participating in a sourcing commitment, some may have less financial incentive to maintain that commitment. Changes in participation or sourcing could then affect buyers’ choices among suppliers. That is a plausible risk to the Moratorium—not evidence that U.S. soybeans have gained an advantage.

The USDA Foreign Agricultural Service warned that reinstating the Mato Grosso law could hinder the Moratorium’s future. Its warning concerns the commitment’s prospects; it does not establish that buyers have switched to U.S. soy, or quantify any effect on prices, demand, or market share. What buyers and investors can—and cannot—conclude

  • Established: The STF upheld Mato Grosso and Rondônia laws restricting certain public benefits for companies participating in similar agreements, while recognizing the Soy Moratorium’s constitutionality.
  • Not established: That the decision has ended all relevant tax benefits, that companies have withdrawn from the Moratorium, or that U.S. soybean exports have gained sales or pricing power.
  • What would clarify the market effect: Evidence of changes in company participation and sourcing, followed by trade or pricing data that connect those changes to U.S. soybean demand.
