No: the Biden administration did not make E15 permanently available nationwide by 2024. EPA finalized a permanent year-round sales rule for eight Midwestern states in February 2024, but its effective date was delayed until April 28, 2025. Nationwide sales during the 2024 summer season came instead through temporary emergency waivers.
What is E15?
E15 is gasoline blended with 15% ethanol. Whether a station offers it, and when it may be sold, depend on the applicable federal rules and local availability.

The two actions were legally distinct. The permanent rule responded to state petitions; the nationwide waivers temporarily relaxed restrictions for the 2024 summer driving season. EPA’s April 19, 2024 announcement and its waiver history document the temporary action and extensions. Can you buy E15 year-round now?
The rule’s effective date was April 28, 2025, for the eight covered states. It did not establish permanent nationwide year-round authorization. The 2024 nationwide allowance was temporary and ended September 15, 2024. A rule allowing year-round sales also does not establish that every station carries E15; the cited federal sources describe legal authorization, not a guarantee of local retail availability.

Why did EPA regulate summer fuel sales?
Gasoline volatility matters because fuel that evaporates more readily in warm weather can contribute to ground-level ozone, or smog. The Clean Air Act gives EPA authority over fuel requirements, including Reid Vapor Pressure (RVP) limits. EPA’s 2024 rule removed the 1-psi RVP waiver for E10 in the eight states and addressed E15 volatility regulations that had been vacated by the D.C. Circuit. The emergency waivers for summer 2024 followed a separate legal pathway from that permanent rule.
What could E15 mean for drivers’ fuel costs?
In its April 19, 2024 waiver announcement, EPA estimated that E15 was about $0.25 per gallon cheaper than E10 on average at that time. This was EPA’s dated average estimate, not a current quote or a guaranteed saving at any particular station. The announcement does not establish what a driver will pay today.
