The European Union has no sector-specific gambling legislation, the European Commission said in 2020. Since then, EU institutions have addressed loot boxes through consumer-protection guidance and calls for common rules, but those steps are not an enacted blanket EU ban.
What Belgium’s loot-box position covered
Belgium’s Gaming Commission examined loot-box systems in games and, according to a Belgian parliamentary record recounting its 2018 report, concluded that paid loot boxes in the games it examined met the elements of a game of chance. The record also says publishers responded by changing or withdrawing features from Belgium. A 2020 European Parliament study described Belgium as one of the countries whose authorities had banned loot boxes. That description concerns national action; it does not mean Belgium had authority to prohibit the feature throughout the EU. European Parliament study, 2020
Why Belgium’s action was not an EU-wide ban
On 10 January 2020, Commissioner Didier Reynders explained the legal distinction in a European Commission answer to a parliamentary question: “The Commission would like to remind the Honourable Member that there is no sector-specific EU gambling legislation.” National gambling rules may apply where a loot box meets the relevant national criteria. In practical terms, the Belgian position was a national gambling-law approach, while EU consumer law is a separate route for addressing how paid random content is sold and presented. Neither the Commission’s statement nor Belgium’s national position amounted to a common EU prohibition.
What the European Commission asked game-industry groups to do
In a September 2022 letter to the industry umbrella organisations ISFE and EGDF, the Commission highlighted consumer-law obligations for paid random content. Its webpage lists the letter as published on 5 July 2023. The Commission said that loot-box offers must comply with information duties under the Consumer Rights Directive and the Unfair Commercial Practices Directive, including disclosure of the price and main characteristics. It also said a game should not be presented as free unless it is entirely free, and that games must not directly exhort children to buy loot boxes or other paid add-ons. This was guidance about consumer-law duties, not an EU gambling-law ban. It addressed how paid content is marketed and sold rather than declaring all loot boxes unlawful.
What the European Parliament has called for
In 2023, Parliament called for analysis of loot-box sales and development of a common EU approach. Its current overview also says that a resolution adopted in November 2025 urged the Commission to outlaw loot boxes and other randomised features when they provoke gambling-like behaviour in children. The Commission says national enforcement may follow if concerns about virtual-currency practices are not addressed. That action concerns in-game currencies and consumer-law issues more broadly, so it should not be confused with a new EU-wide loot-box prohibition.
