Allstate Lawsuit Claims Driving Data From More Than 45 Million Americans

Texas and private plaintiffs allege Allstate and Arity gathered app-based location and driving data. The 45 million figure remains an allegation, and a federal court’s mixed dismissal ruling is not a final finding of liability.

A 2025 lawsuit by Texas and a separate federal case brought by private plaintiffs accuse Allstate and its subsidiary Arity of gathering detailed location and driving-related data through software embedded in mobile apps, then using or making it available for insurance purposes. The claim that the data involved more than 45 million Americans comes from the plaintiffs and the Texas Attorney General; the court record reviewed here does not establish that number or find that Allstate is liable.

What the lawsuits allege

The controversy involves two separate cases: an enforcement action brought by Texas and private litigation in federal court. They make related allegations, but they are not the same lawsuit.

Texas’s state lawsuit

On January 13, 2025, the Texas Attorney General announced a lawsuit against Allstate and Arity. The Attorney General alleged that the companies unlawfully collected, used, and sold phone location and movement data gathered through software embedded in mobile apps, naming Life360 as an example. The state further alleged that the information was used in insurance decisions. These are the state’s claims, not findings of fact. The Texas Attorney General’s announcement says the alleged database involved more than 45 million Americans and trillions of miles.

Private federal litigation

On February 5, 2025, plaintiffs filed Arellano et al. v. The Allstate Corporation et al. in the U.S. District Court for the Northern District of Illinois. Their complaint alleges that an Arity software development kit (SDK)—software that an app developer can incorporate into an app—was integrated into third-party apps and gathered information including location, accelerometer and gyroscope readings, speed, and other movement-related details.

The plaintiffs allege that the resulting profiles were used by Allstate or made available or sold to other insurers for underwriting and premium decisions. They claim the database covered more than 45 million Americans and trillions of miles. The complaint sets out those allegations; it does not independently verify the scale of the database or establish that every person using an app named in the case was affected.

What “45 million” means—and what it does not

The figure is an allegation about the claimed scale of a driving-behavior database. Both the Texas Attorney General’s announcement and the private plaintiffs use it, but the reviewed court materials do not show a judge independently confirming the count. The same distinction applies to the complaint’s description of the data as covering “trillions of miles.” Neither figure should be read as a court-established measurement or as proof that every person’s data was collected.

The claims also do not establish a quantified amount of consumer loss. The materials reviewed do not provide a population-level estimate of how many people experienced a particular insurance consequence or how much any individual’s premium changed.

What the federal court has decided so far

In April 2025, the Northern District of Illinois consolidated related private cases under In re: Allstate & Arity Consumer Privacy Litigation, master docket 1:25-cv-00407. In a 2026 ruling on defendants’ motion to dismiss, the court granted the motion in part and denied it in part. The order explains that allegations in the complaint are “taken as true for purposes of the present motion”—the procedural standard for deciding whether claims may proceed, not a finding that the alleged events happened.

The court rejected dismissal arguments concerning whether the consolidated complaint plausibly alleged data collection and lack of consent for the claims it addressed, while dismissing certain other claims. It explained that consent is an element of some causes of action and an affirmative defense for others. The judge summarized the outcome: “For the reasons stated and as outlined in this order, the defendants’ motion is granted in part and denied in part.” Read the 2026 memorandum opinion and order in that context: it is a mixed ruling at the motion-to-dismiss stage, not a trial verdict or final judgment on liability.

What app users can reasonably take from the case

The allegations concern software embedded in third-party apps and data that can include location and motion-sensor signals. The court’s discussion also addresses app notices and consent, with terms and circumstances varying across users and claims. The materials do not establish that every app named in a complaint transmitted the same information or that all users were affected.

  • Review location and motion-related permissions in your phone’s settings and the privacy controls and notices for apps you use.
  • Changing permissions or uninstalling an app may affect future access, but the reviewed court materials do not establish that either step reverses past data sharing or changes an insurance decision already made.

What remains unresolved

The 2026 order addressed a motion to dismiss, not the ultimate merits of the claims. The court record reviewed for this article does not establish later docket developments, a settlement, a trial date, or a final outcome. It also does not provide a verified on-record response from Allstate or Arity to the allegations. Those limits matter: the cases raise serious claims about app-collected data and insurance use, but the allegations and the court’s procedural ruling should not be mistaken for a final determination.
