Compare the total cost and restrictions against your household’s plans—not just the monthly assessment. Rules and required disclosures vary by state, property type, and association, so have a qualified local professional interpret documents when needed.
Start with the documents that control the community
Request the complete, current document package, including amendments. A summary from a seller or sales office is not a substitute for the rules the association actually follows. California’s Department of Real Estate advises buyers to examine the CC&Rs, association rules, and architectural guidelines before purchasing in a common-interest subdivision.
- Declaration or CC&Rs: Review use restrictions, maintenance obligations, assessments, and the association’s authority.
- Bylaws and articles of incorporation, where applicable: Check how the association is organized, how its board is selected, and how decisions are made.
- Rules and architectural guidelines: Look for practical limits on pets, vehicles, parking, exterior changes, rentals, and shared facilities.
- Financial and disclosure materials: Request the current budget, assessment information, reserve study or analysis, insurance information, and available meeting materials.
- Problem disclosures: Ask about unresolved violations, construction defects, litigation, or contemplated legal action.
The precise disclosure package required depends on the property’s location and type. California’s buyer guidance discusses these document and disclosure issues at the Department of Real Estate’s buyer guide.
Calculate the cost beyond the monthly assessment
A low regular fee does not by itself show that a community is affordable or financially prepared. Compare the regular assessment with approved increases, special assessments, services included in the fee, and costs that could move to the association in the future. Ask whether developer-provided services or responsibilities are expected to transfer to the HOA and what that might mean for expenses.

Review the budget and available meeting materials for signs of planned work, borrowing, deferred repairs, or assessment changes. For subdivisions covered by its disclosure rules, the CFPB regulation calls for information about whether association income is sufficient for operations, maintenance, repairs, and replacement reserves, as well as certain developer-control and service questions. That regulation applies to specified disclosures; it is not a universal HOA disclosure checklist. See CFPB Regulation Z, section 1026.37.
Check whether reserves match the property’s repair needs
A reserve figure makes sense only in relation to the components the association must maintain, their condition, when they are expected to need repair or replacement, and the likely cost of that work. Hawaii’s condominium regulator describes those elements as part of a reserve analysis. A shortfall may contribute to special assessments, borrowing, or deferred maintenance; no single reserve amount is suitable for every property.

Ask for the latest reserve study or analysis and find out which projects are funded, when major work is anticipated, and whether the association has borrowed or postponed repairs. Hawaii’s guidance concerns condominium reserves and should not be treated as a nationwide rule for every type of community. Its explanation is available in the Hawaii condominium FAQ booklet.
Find out who maintains and insures each major component
Do not assume that the association maintains everything outside your front door—or that your own insurance covers every component assigned to you. Ask for the responsibility and insurance allocation for roofs, exterior walls, roads, landscaping, amenities, and other shared property. Match those answers against the governing documents and insurance information. The allocation affects both the work you may have to arrange and the costs you may face.

Get the 55+ policy in writing
A community’s “55+” label does not settle every question about who may live there, visit, or rent a home. Ask for the written age policy, how ages are verified, and what happens when household circumstances change. Also check guest, rental, and occupancy rules before relying on an assumption about a child, younger relative, caregiver, or future household member.
Utah’s Department of Commerce summarizes the Housing for Older Persons Act (HOPA) criteria as requiring at least 80% of occupied units to have at least one resident aged 55 or older, written policies showing the community’s intent to operate as housing for older persons, and reliable age-verification procedures. The 80% figure is a HOPA criterion described in Utah’s 2026 guidance—not a guarantee that a specific community permits a particular household arrangement. Communities may set different policies for temporary stays by younger relatives and circumstances such as pregnancy, adoption, custody, or rentals. Review the actual policy and confirm it in writing. Investigate disputes, defects, and board control
Ask whether the association is involved in litigation or considering a suit, whether there are unresolved construction defects, and whether legal costs have been paid from reserves. Litigation spending can affect future assessments and may complicate financing or resale, as California’s buyer guidance notes. Also ask who currently controls the board, how long any developer control is expected to continue, and what services the developer still provides.
Review available minutes or other meeting materials for how the board communicates, considers major work, and explains financial decisions. If you are buying in Utah and later have a dispute, the state agency advises putting it in writing and following the process in the governing documents before seeking its advisory opinion. That is Utah-specific guidance, not a national dispute procedure. The state’s information is on the Utah HOA page.

Compare communities using the same questions
Use the same checklist for each community so the monthly fee or sales presentation does not dominate the comparison. There is no universal “right” HOA fee or reserve figure; weigh the association’s obligations, property condition, finances, rules, and your own budget and priorities.

Get help with interpretations, not just document collection
An HOA packet can raise legal or financial questions that depend on state law, property type, and the wording of the documents. A buyer’s agent may explain the practical application of disclosures within the agent’s competence; legal interpretations or financial advice should go to an appropriate qualified professional. The California Department of Real Estate discusses this distinction in its buyer guidance. Verify the requirements for the specific property’s jurisdiction before relying on a general state or federal resource.
