How to Ask Your Bank to Waive an Overdraft Fee

Contact the bank through an official channel with the fee date, amount, and transaction details. Ask for a courtesy refund, or request a review if you believe the charge was improper.

Contact your bank through its secure message center or the phone number on your card or statement. Give the fee amount and posting date, explain the transaction briefly, and ask directly for a one-time courtesy waiver or refund. A courtesy request is not a guaranteed right; if you think the charge was improper, ask the bank to review the transaction and the account terms as well.

Prepare before you contact the bank

Check your transaction history and account fee schedule so you can describe the charge accurately. Gather:

  • The overdraft fee amount and posting date.
  • The transaction that led to the negative balance, including whether it was an ATM withdrawal, one-time debit card purchase, check, recurring debit, or ACH payment.
  • The available balance and the timing of any deposit or pending transaction, if those details may explain what happened.
  • For an ATM or one-time debit transaction, any record showing whether you opted in to overdraft coverage.

Use an official bank contact channel and keep the response and any case or reference number. Contact the account-holding institution; waiver practices and charges vary by bank and account.

Ask for a courtesy waiver—or dispute a specific fee

For a straightforward courtesy request, be concise and specific. You can say:

“I’m calling about the overdraft fee of [amount] posted on [date]. The transaction was [brief explanation]. Could you review what caused the fee and waive or refund it as a one-time courtesy? If you can’t waive it, please explain the account term and transaction that led to the charge.”

If you suspect an error, state the reason and ask for a review rather than presenting an unsupported accusation. For example: “The available balance shown at the time was [amount], and I’d like you to explain the authorization and settlement timing.” Ask the representative to explain the fee and note the outcome of the conversation.

Check whether the debit-card opt-in rule applies

Federal Regulation E treats ATM withdrawals and one-time debit card transactions differently from checks, recurring debit transactions, and ACH payments. For covered ATM and one-time debit overdraft fees, the bank generally must have given the required notice and received your affirmative consent before charging the fee. It must also provide confirmation of the opt-in and explain that you can revoke it. These opt-in requirements do not apply to fees on checks, recurring debits, or ACH payments. A bank may still decide whether to pay a transaction even when you opted in. See the CFPB’s Regulation E overdraft-services requirements and official interpretation.

If you did not authorize coverage for an ATM withdrawal or one-time debit purchase, ask the bank to identify the consent record and review the charge. You might say: “I did not opt into overdraft coverage for ATM and one-time debit transactions. Please check your records and review the fee.” Use this only if it matches your records. The CFPB says consumers who believe they were charged a covered debit overdraft fee without authorizing coverage may submit a complaint; a complaint is an escalation route, not a guarantee of a particular result.

If the bank refuses the request

  1. Ask which transaction and exact account term triggered the charge.
  2. If it involved an ATM or one-time debit transaction, ask how and when the bank recorded your affirmative consent. Request a copy or an explanation of that record.
  3. If the charge still appears inconsistent with the consent requirement or your account terms, submit a CFPB complaint. Include the dates, transaction type, amount, the bank’s response, and relevant records.
  4. For a check or recurring electronic payment, ask the bank to review the applicable account terms; the debit/ATM opt-in requirement does not govern those transaction types.

A separate situation can arise when a deposited check later proves fraudulent. The CFPB says a bank may take back funds from a fraudulent check even after making them available, potentially leaving the account overdrawn. Ask the bank how to resolve the shortfall; see its guidance on overdrafts following a fraudulent deposited check.

Reduce the chance of another overdraft fee

The CFPB describes several options to discuss with your institution. Compare what transactions each option covers, what happens when funds are short, and any fees or interest before choosing.

You can change your debit overdraft decision by notifying the bank. Ask it to confirm when the change takes effect and which transaction types it covers. The CFPB’s overdraft options guide explains these choices. The official interpretation of Regulation E states, “a consumer may revoke his or her prior consent at any time.” Revoking consent affects future covered transactions once implemented; it does not itself require the bank to refund an earlier fee.

Use general fee figures as context, not a quote

The CFPB’s 2025 consumer guidance says many banks and credit unions charge $30 or more per overdraft transaction. Its 2022 circular noted that overdraft fees can be as high as $36 and discussed how authorization-to-settlement timing and transaction ordering may produce fees consumers did not expect. These are general figures, not the fee at your institution. Check your current account fee schedule for the amount and terms that apply to you.
