Did First Citizens Get a $21 Million Silicon Valley Bank Tax Refund?

The March 2026 ruling concerns an FDIC receivership refund claim, not a $21 million award to First Citizens.

No available court record confirms that Silicon Valley Bank’s successor will receive a $21 million tax refund. A March 27, 2026 federal court opinion instead dismissed a refund counterclaim brought by the FDIC as receiver for Silicon Valley Bank on jurisdictional grounds. It did not award a refund or identify First Citizens as its recipient.

What the March 2026 court ruling decided

In its March 27, 2026 opinion, U.S. District Judge Sparkle L. Sooknanan granted New York City’s motion to dismiss the FDIC receiver’s affirmative counterclaim for a municipal tax refund. The court applied the Tax Injunction Act, which limits federal courts from interfering with state and local tax matters when an adequate remedy is available through those jurisdictions.

The opinion quotes 28 U.S.C. § 1341: “district courts shall not enjoin, suspend or restrain the assessment, levy or collection of any tax under State law where a plain, speedy and efficient remedy may be had in the courts of such State.” The judge said the receiver could pursue a refund action with the New York City Tax Appeals Panel and could raise its claimed refund entitlement as a defense to the City’s claim.

This was a jurisdictional ruling, not a decision on whether the FDIC receiver qualified for a refund. The court did not order New York City to pay money.

What the FDIC receiver claimed

The City sued the FDIC in its capacity as SVB’s receiver over alleged municipal banking corporation tax deficiencies for 2017 through 2021. The court records the City’s total claim as $2,138,588.95, consisting of:

  • $1,442,664.96 in principal;
  • $335,257.75 in interest; and
  • $360,666.24 in penalties.

Those amounts are the City’s deficiency claim, not a refund amount awarded to the FDIC or First Citizens.

The FDIC receiver later filed amended New York City returns for 2019 through 2021. It argued that operating losses from 2022 and 2023 could be carried back to reduce the earlier tax liability, creating a refund claim for the receivership. The opinion says the City was conducting a routine audit of the amended return. It does not describe a completed audit or a final refund determination.

Why “successor” does not establish who gets the refund

Silicon Valley Bank, Silicon Valley Bridge Bank, the FDIC receiver, SVB’s former holding company and First Citizens are distinct entities or roles. The opinion describes California regulators closing Silicon Valley Bank on March 10, 2023, and appointing the FDIC as receiver. The refund counterclaim was brought by the FDIC in that receivership capacity—not by First Citizens.

According to the FDIC’s Silicon Valley Bank resolution page, First-Citizens Bank & Trust Company entered a purchase and assumption agreement on March 26, 2023, for the deposits, excluding Cede & Co. deposits, and loans of Silicon Valley Bridge Bank. That establishes a transfer involving those deposits and loans; it does not establish that First Citizens owns or will receive the FDIC receiver’s tax-refund claim.

What is and is not established about the $21 million figure

The court opinion does not state that a $21 million refund was awarded, paid or owed to First Citizens. The documented figures in the opinion concern the City’s deficiency claim, while the FDIC receiver’s amended-return position remained subject to an audit and the counterclaim was dismissed without a decision on refund eligibility. The available record therefore does not substantiate the headline’s $21 million amount or its attribution to SVB’s successor.

To establish that First Citizens will receive a refund, a later court filing, tax-authority determination or other primary record would need to connect a specific refund amount to First Citizens. The March 2026 opinion does not do so.
