On August 13, 2024, the United Auto Workers (UAW) announced that it had filed federal labor charges against Donald Trump and Elon Musk. The union said remarks in their X Spaces conversation the previous evening advocated firing striking workers and threatened workers engaged in protected activity. That is the UAW’s allegation, not an established legal finding.

What did Trump say about striking workers?

In its August 13 announcement, the UAW said Trump and Musk spoke on X Spaces the night before and that the conversation drew more than one million listeners. That audience figure is the union’s estimate, not an independently verified count.

The union quoted Trump describing a hypothetical response to a strike: “I mean, I look at what you do,” Trump told Musk. “You walk in, you say, You want to quit? They go on strike, I won’t mention the name of the company, but they go on strike and you say, That’s OK, you’re all gone. You’re all gone. So, every one of you is gone.” The UAW characterized the remarks as advocating the illegal firing of striking workers. The quote and that interpretation appear in the union’s announcement; neither establishes that workers were actually fired or that a law was violated.

What did the UAW accuse Trump and Elon Musk of doing?

The UAW said it had filed federal labor charges against both men, alleging their remarks threatened and intimidated workers engaged in protected activity. UAW President Shawn Fain called Trump a “scab” and said, “When we say Trump stands against everything our union stands for, this is what we mean.” Fain also said, “Both Trump and Musk want working class people to sit down and shut up, and they laugh about it openly.” These are statements by the union president expressing the union’s position, not findings by a labor agency.

Can you fire workers for going on strike?

There is no universal yes-or-no answer for every worker or every strike. The National Labor Relations Board (NLRB) says employees covered by the National Labor Relations Act (NLRA) have the right to act together to improve wages and working conditions, with or without a union. Whether a particular worker or activity is covered depends on the circumstances; the NLRB lists exclusions that include government employees, agricultural laborers, independent contractors, supervisors in most circumstances, and workers covered by the Railway Labor Act.

The NLRB describes protected concerted activity as action by two or more employees for mutual aid or protection concerning employment terms. An individual employee can also sometimes act on behalf of coworkers or prepare for group action. Examples include employees jointly raising pay concerns, discussing workplace safety, or speaking to an employer for coworkers. This framework explains the kind of rights the UAW invoked; it does not by itself determine whether the specific remarks in the X Spaces conversation violated the law.

Have the charges been decided?

The UAW’s announcement establishes that the union said it filed charges; a charge is an allegation, not a ruling. The cited public sources do not establish a current docket status, decision, or disposition for these specific charges. Accordingly, the accusation should not be described as a proven violation or as a case with a confirmed outcome.
