For an appeal against an income-tax penalty order in India, first identify which Income-tax Act governs the proceeding: official guidance uses Form 35 for covered appeals under the Income-tax Act, 1961, and identifies Form 99 for appeals under section 358 of the Income-tax Act, 2025. For the penalty appeals covered by the provisions reviewed, the filing period is generally 30 days from service of the penalty notice of demand—not simply 30 days from the date printed on the order. The order, demand notice, applicable transition rules and current e-filing instructions determine what you should file.
First identify the law, appealable order and correct form
Do not choose a form based only on the year shown on a notice or on which form you have used before. Read the penalty order and its accompanying notice of demand to identify the statutory provision, issuing authority and proceeding. Then confirm that the order is appealable to the Commissioner (Appeals) under the law that governs it.

The table is a starting point, not a rule for every pending or transitional case. The official materials do not settle every situation that spans the change from the 1961 Act to the 2025 Act. If the order or proceeding crosses that transition, verify which statute, form, limitation provision and savings rule apply before submitting anything. The applicable portal workflow can also change, so check its current instructions when filing.
Calculate the 30-day period from service of the demand notice
For the covered penalty appeals described in the official materials, the appeal period is 30 days from service of the notice of demand relating to the penalty. The date printed on the penalty order is not necessarily the date from which to count. Keep the demand notice and whatever record establishes when and how it was served.

Check the applicable limitation rules against the facts of your case, including whether a statutory exclusion affects the calculation. If the last day is near or has passed, do not assume that an appeal can be filed late automatically: an authority may admit a delayed appeal when sufficient cause is established, but condonation is discretionary.
Prepare the appeal around the order and the record
An appeal should state what is being challenged and why, with each ground tied to the order, the relevant record and the applicable legal provision. For the 1961 Act workflow, the Income Tax Department’s Form 35 manual describes the memorandum of appeal, statement of facts, grounds of appeal, appealed order and notice of demand as core appeal materials. For a 2025 Act appeal, use the applicable Form 99 instructions and current portal checklist rather than assuming the Form 35 document requirements carry over unchanged.

- Read the penalty order and demand notice, noting the provision cited, issuing authority, order date, demand amount and service details.
- Draft a concise statement of facts and separately numbered grounds. Identify the particular finding, action or legal basis you dispute and connect it to the supporting record.
- Assemble the appealed order, notice of demand, relevant correspondence and evidence relied on. Check the applicable form and portal instructions for document format, verification and any additional required material.

File through the applicable e-filing workflow
- Confirm the governing statute and forum. Match the penalty order to the relevant appealability provision and establish which Act governs the proceeding, especially where the transition between the 1961 and 2025 Acts may matter.
- Confirm the limitation date. Use the service date for the penalty notice of demand under the applicable provision, and retain evidence of service and your calculation.
- Complete the correct form. Use Form 35 for a covered 1961 Act appeal or Form 99 where the 2025 Act and current official instructions apply. Follow the live portal workflow and complete its verification requirements.
- Upload the supporting materials and pay the prescribed fee. Check the applicable fee category and any other statutory admission conditions before submission.
- Save proof of submission. Retain the filed form, uploaded documents, payment confirmation and portal acknowledgement for your records.
Appeal fee and tax-payment conditions
The Department’s Form 35 guidance lists the following fee bands for covered appeals under the 1961 Act. Section 358 of the 2025 Act states corresponding amounts. Confirm which statute and category apply to your case, and follow the portal’s current payment instructions.

The appeal fee may not be the only admission condition. Section 249 of the 1961 Act and section 358 of the 2025 Act also provide tax-payment conditions, with an exemption mechanism in specified circumstances. Which condition applies depends on the appellant’s return and payment facts. Check the exact provision and the applicable exemption procedure rather than assuming that payment of the appeal fee alone is sufficient.

You may apply for admission of a late appeal by explaining the delay and showing sufficient cause, with supporting evidence. The authority decides whether the statutory standard is met; a late appeal is not guaranteed to be accepted. Preserve documents that support both your explanation and the relevant dates, and confirm the applicable procedure for presenting the request.
