Getting Debt Collection Calls Twice a Day About a Debt You Don’t Recognize? What to Do

Don’t pay or share sensitive information with an unverified caller. Request written debt validation, dispute an unfamiliar claim promptly, and keep a call log; two calls a day alone do not prove a legal violation.

Don’t pay or share sensitive information with an unverified caller, but don’t ignore the calls indefinitely. Ask for the collector’s identity and written validation information, then dispute the debt in writing if you don’t recognize it. Keep a record of every call. Two calls a day is worth documenting, but by itself it does not prove the collector broke federal law.

What to do first when an unknown collector calls

  1. Don’t volunteer sensitive information or agree to pay. Until you verify who is calling and what the debt is, don’t give a Social Security number, date of birth, bank details, or payment information. Don’t admit that you owe it or promise to pay.
  2. Ask for identifying details. Request the caller’s full name, company name, mailing address, phone number, the creditor’s name, the amount claimed, and instructions for disputing it. You can end the call without negotiating. The CFPB advises getting written validation information before paying or discussing payment: CFPB: What should I do if a debt collector contacts me?
  3. Don’t rely on caller ID or area codes. A displayed number or local-looking area code does not establish that a call is legitimate, that it is a different collector, or that the debt is yours. If you choose to contact the company, use contact details you have independently confirmed rather than simply calling back the displayed number.
  4. Save the evidence. Note each call’s date and time, displayed number, caller and company claims, and whether you spoke with anyone. Keep voicemails, letters, texts, and emails.

How to identify the debt

A debt collector generally must provide validation information during its initial communication or within five days of it. The information generally identifies the collector and creditor, states the current amount and itemization, and explains how and by when to dispute. Review the notice carefully and use the deadline printed there. See the CFPB explanation of a debt validation notice.

If you have never answered, the calls alone may not give you enough information to work out what the claim concerns. You can request the validation information in writing rather than trying to resolve the matter during a phone call. Do not assume the debt is valid—or that it is a scam—just because you do not recognize it.

How to dispute a debt you don’t recognize

If the notice identifies a debt you believe is not yours, has the wrong amount, or otherwise appears inaccurate, send the collector a written dispute using the notice’s instructions. The written dispute period is generally 30 days after you receive the validation information, but the notice provides the applicable deadline. Dispute as soon as you can and keep a copy.

A timely written dispute of the debt, or part of it, generally requires the collector to pause collection of the disputed amount until it sends verification or a copy of a judgment. If you timely ask in writing for the name and address of the original creditor, when it differs from the current creditor, collection generally pauses until that information is provided. The CFPB describes these rights in its validation-notice guidance.

Be specific about what you dispute, but don’t include unnecessary personal or financial details. Send the letter to the address or through the method shown on the notice. Certified mail with a return receipt can provide evidence that the collector received your letter; it is optional, not a prerequisite. Some collectors may offer an electronic submission method.

Do two calls a day violate the law?

Not automatically. Under the federal Fair Debt Collection Practices Act and Regulation F, the CFPB says a collector is presumed to violate the call-frequency rule if it calls about a particular debt more than seven times within seven days, or calls within seven days after a telephone conversation about that debt. Calls that go to voicemail count toward the threshold. These are legal presumptions, not a guarantee that a pattern below the threshold is lawful or that every case above it is decided without considering the circumstances. Repeated or continuous calls made with intent to annoy, abuse, or harass are prohibited.

The CFPB explains the rule in When and how often can a debt collector call me? Track each call, including whether it went to voicemail and whether you had a conversation. Because the numbers may relate to different debts or callers, the area codes alone don’t establish how the calls should be counted. Two calls daily are enough to make careful records worthwhile, but that fact alone does not establish a violation.

Disputing the debt and stopping calls are different actions

A dispute challenges whether the debt is owed or whether its details are accurate. A separate written request can ask the collector to stop contacting you. A stop-contact request does not erase the debt or prevent every legally permitted next step; after receiving it, a collector may generally contact you to confirm there will be no further contact or to notify you of a legally permitted action. The CFPB explains how to ask a debt collector to stop contacting you.

If you want to challenge the claim, send the dispute promptly rather than relying only on a stop-contact letter. You may make either request or both, but make clear which action you are taking. Keep a copy and proof of delivery for each letter.

When to get help or file a complaint

If the collector does not provide required validation information, continues conduct you believe is unlawful, or fails to respond appropriately to a timely dispute, keep your records and consider submitting a complaint to the Consumer Financial Protection Bureau. You may also consider speaking with a consumer-law attorney.

State laws may provide additional protections, and deadlines for suing on a debt depend on the state and details such as the type and age of the debt. Without your state, the collector’s identity, and the debt information, it isn’t possible to determine whether a specific limitation period or state rule applies.
