Start with the state utility commission’s official docket—not a headline or a bill estimate. Find the filing and deadline, identify which proposed costs or rate rules involve large electricity users, then submit a concise comment through the process the commission specifies. A utility’s request is a proposal for regulators to review; whether data-center demand would raise your bill, and who should pay for related costs, depends on the evidence and rules in that specific case.
1. Find the live rate case and its deadline
Search your state utility commission’s website using the utility’s name and terms such as “rate case” or “rate increase.” If your notice or bill insert gives a docket number, search that exact number. Use the docket page to confirm the filing title, current stage, comment instructions, public-hearing dates and deadlines. Procedures and accepted formats vary by state and case.
Make a note of the docket number and deadline before reading further. A hearing date or comment window mentioned in an older notice may have passed; rely on the current docket page rather than an old event announcement.
2. Work out what the utility is asking the commission to approve
A proposed bill increase can involve different questions: whether the utility’s spending is justified, how approved costs are divided among customer groups, or how rates collect those costs. Separating them makes it easier to comment on the issue the commission is actually considering.

Costs and rate design are not the same thing
California’s general rate case process illustrates the distinction: the commission first considers the utility’s total justified revenue requirement and then how approved revenue is allocated among customer classes. The allocation phase does not approve additional costs. This is a California example, not a universal sequence; check your own docket to see which issues are open.
Look for data-center-related assumptions
Search filings for “data center,” “large load,” “large customer,” “generation,” “transmission,” “distribution,” “capacity,” “forecast,” “tariff” and “stranded costs.” The U.S. Department of Energy identifies fair cost allocation, stranded-asset risk and resource adequacy as important rate-design concerns for data centers and other large electricity users.
- What new power plants, transmission lines or local grid upgrades does the utility propose, and what evidence supports their need and cost?
- When is the large customer expected to start using power, and how quickly is its demand forecast to grow?
- Does the proposal account for the possibility that the customer uses less electricity than forecast, delays its project or leaves?
- Are there minimum payments, deposits, collateral, termination charges or other protections for customers if the utility invests ahead of demand?
- What reliability measures, such as contracted capacity, ramp schedules or curtailment rules, are part of the proposal?
- Can the public and case participants inspect the assumptions and cost evidence needed to evaluate the request?
Not every filing will answer these questions publicly. The Minnesota Public Utilities Commission says some customer-demand, infrastructure-cost, schedule and rate information may be treated as trade secret. Note what the public record establishes and what it does not; do not assume a missing public detail proves either that a cost is justified or that it is being shifted to households.

3. Compare proposed tariffs or settlements on the costs they assign
If the docket presents alternatives, compare the actual terms rather than relying only on a general claim that large customers will “pay their fair share.” These are questions to apply to the record, not provisions every tariff necessarily contains.

State examples are not national rules
Minnesota’s PUC describes state requirements for large customers to bear necessary electrical-upgrade costs and for utilities to propose special rates for large customers. That describes Minnesota’s framework, not a rule you can assume applies in another state.
In Ohio, the Office of the Ohio Consumers’ Counsel reported that the Public Utilities Commission of Ohio adopted a settlement on July 9, 2025 requiring new large data centers to pay at least 85% of the electricity capacity they contract for, for up to 12 years, even if they use less. OCC also reported an industry appeal in November 2025. The later status of that appeal is not established here, so check the current Ohio docket and court record before treating the terms as operative.

4. Write a specific, evidence-based public comment
A useful comment identifies the case and explains what part of the proposal concerns you. Refer to the filing, testimony, tariff or hearing evidence you are responding to when possible. Ask the commission to examine a specific issue—such as who pays for an upgrade if forecast demand fails to arrive—rather than asserting a household-bill effect that the docket does not establish.
You can use this outline and adapt it to the commission’s instructions:
- Identify the case: Give the docket number and the utility or filing name.
- State your concern: Point to the cost, forecast, allocation rule or customer protection you want the commission to review.
- Explain why it matters: Connect your concern to evidence in the filing or to a clear question the record leaves unanswered.
- Make a focused request: For example, ask the commission to require a clearer explanation of who bears underused-upgrade costs or whether the proposed tariff covers contracted capacity.
- Submit as directed: Follow the current docket’s format, portal and deadline, then save a copy of your comment and any confirmation.
A utility’s requested increase is not automatically approved. Regulators review the record and may approve, change or reject requested spending and rates. Avoid claiming that data centers caused a particular increase to your household bill unless evidence in the case supports that conclusion. The official sources cited here do not establish a reliable nationwide percentage of household rate increases attributable to data-center demand.

5. Choose the right way to participate
In some cases, members of the public can file comments without becoming formal parties. California’s process distinguishes public comments from intervention: someone seeking party status must follow the formal process to become an intervenor. Formal participation may involve procedural obligations, so consult the docket instructions before deciding which route to take.
Ohio’s Consumers’ Counsel describes hearing testimony entering the case record and provides a docket comment route. The available routes and their effects differ by jurisdiction; use the current case instructions rather than assuming a process from another state applies to you.
If the case is technically complex or you are considering formal intervention, check whether a state consumer counsel, citizens’ utility board, community group or legal aid provider is active in it. These organizations may offer information or advocacy, but availability and representation vary; do not assume one represents you unless it confirms that directly.

6. Use the federal process only when the issue belongs there
For a household rate increase from a regulated utility, begin with the state commission’s retail-rate docket. FERC’s 2026 fact sheet says its large-load orders do not displace state authority over retail electricity rates, terms and conditions. FERC addresses interstate transmission matters, including transmission-customer cost shifting; that is distinct from a state commission’s review of a utility’s retail rate case.
FERC’s RM26-4-000 docket concerns interstate transmission interconnection and invites comments through eComment, eFiling or paper filing, with the docket number referenced. Its docket describes large loads generally as electricity demand greater than 20 megawatts. That federal proceeding is not a substitute for commenting in your utility’s state retail-rate case. Check which filing is actually at issue before choosing a forum.
