Choose a cryptocurrency exchange by checking the exact legal entity that will hold or handle your assets, the rules and protections that apply where you live, and what the contract says about custody and failure. Then assess security, transparency, withdrawals, fees and privacy. No exchange is best for every investor: protections and risks can change with the country, entity, asset and service.
Start with the legal entity and the rules that apply to you
An exchange’s brand name is not enough to identify who is responsible for your account. Find the legal entity named in the customer agreement and confirm that it is authorized to provide the specific service in your jurisdiction. Check the relevant regulator’s register, and make sure the registration or authorization covers the entity and activity you intend to use.
Authorization is not a guarantee that an exchange will remain solvent or that you cannot lose money. Nor should you assume that crypto held with an exchange has the same protections as a bank deposit or a conventional brokerage security. The SEC’s Investor.gov bulletin, “Crypto Asset Custody Basics for Retail Investors,” published December 12, 2025, advises investors to research a custodian’s background and regulatory status. It also emphasizes that protections depend on the circumstances.
Rules are jurisdiction-specific. In the European Union, the Markets in Crypto-Assets Regulation (MiCA), Regulation (EU) 2023/1114, sets requirements for covered crypto-asset service providers. That does not make every crypto product or service risk-free, and you still need to establish which entity and service apply to your account. FINMA’s January 12, 2026 guidance on custody risks discusses provider oversight and bankruptcy protection in the Swiss context; it is not a global standard.

Read the custody and failure terms before depositing
The SEC bulletin defines crypto-asset custody as “how and where you store and access your crypto assets.” With exchange custody, a third party controls access to the private keys associated with your assets. That may make account access convenient, but it means your ability to access crypto can be affected if the provider is hacked, closes or becomes bankrupt.
Look in the customer agreement and custody disclosures for specific answers to these questions:

- Who controls the keys? Identify the custodian and any subcontractors that store assets or can access keys.
- How are customer assets treated? Check whether assets are segregated or commingled with company assets, and what rights you have to them under the contract.
- Can the provider use your assets? Look for permission to lend, pledge, rehypothecate or otherwise use customer crypto. Do not infer the answer from marketing language.
- What happens on insolvency? Find out what the contract says about customer claims, access to assets and the process if the provider fails. Contract wording and applicable law matter.
- What does insurance cover? Ask whether coverage applies to crypto loss or theft, which assets and events it covers, and what exclusions and limits apply. The word “insured” alone does not establish that your particular balance is protected.
If these terms are hard to find or the provider will not explain them clearly, treat that as a reason to pause rather than assume the most favorable interpretation.
Assess account security and recovery
Ask how the provider protects keys and accounts, including its use of hot and cold storage, controls over key access, physical and cyber safeguards, outsourced custody, incident response and account recovery. Public descriptions can help you understand the provider’s approach, but they do not prove that a particular control is effective or eliminate operational risk.

Your own sign-in practices matter too. The SEC recommends strong, unique passwords and multifactor authentication, and warns investors to watch for phishing. Use the exchange’s genuine app or website rather than a link in an unexpected message, and secure the email account used for exchange recovery. Before relying on an account-recovery process, understand what information the provider may require and what happens if you lose access to your usual sign-in method.
Do not treat proof of reserves as a financial audit
A proof-of-reserves report can offer a limited view of assets at a particular point in time. It does not, by itself, show that all customer liabilities are covered or that the assets will remain available. The SEC’s Investor.gov alert, “Exercise Caution with Crypto Asset Securities,” cautions that such reports may be point-in-time snapshots, may omit liabilities and activity between snapshots, and do not have the defined scope and requirements of a financial statement audit.

When a provider publishes a report, check what it actually covers: the date, assets included, liabilities addressed, methodology and whether an independent auditor performed a financial statement audit. Do not interpret a reserves snapshot as a guarantee of solvency, custody quality or future access.

A provider may be unsuitable even if its custody disclosures look acceptable. Confirm that it supports the assets you intend to hold, the funding methods you can use and withdrawals to an external wallet if you want that option. Check whether withdrawals are available for each relevant asset and network, and read the applicable limits and terms.

Compare the full cost of using the service, not just its trading charge. Review transaction and transfer fees as well as any annual, setup, custody or account-closing charges. Also read the privacy terms to understand what account and transaction information is collected, used or shared. Choose a service that offers the functions you need without making you rely on features or products you do not understand.
Choose between exchange custody and self-custody

A hardware crypto wallet, also called a cold-storage wallet or self-custody wallet, can let you keep key control outside an exchange. Physical devices typically cost money, and using one does not make an investment safe or remove the need to protect the recovery phrase. Exchange-held balances remain subject to exchange custody risk; moving assets to self-custody changes who is responsible for access, not the investment’s market risk.
Use a due-diligence checklist before committing
- Identify the contracting entity. Read the agreement, record the legal name and jurisdiction, and check the relevant regulator’s register for authorization covering the service you plan to use.
- Read the custody and insolvency terms. Establish who controls keys, whether assets are segregated, whether the provider can use them, and what the agreement says about a failure.
- Verify security and recovery details. Review key-storage practices, outsourced custody, account protections and the recovery process; enable multifactor authentication and use a strong, unique password.
- Interpret disclosures narrowly. If the provider publishes proof of reserves, check its date and scope and do not treat it as proof that liabilities are fully covered or as a financial statement audit.
- Confirm your intended use. Check supported assets, funding methods, withdrawal availability and terms, all relevant fees and privacy practices.
- Decide where you want key responsibility to sit. Compare exchange convenience and provider dependence with the security and recovery duties of self-custody before transferring a substantial balance.
Recheck the decision over time
Long-term investing does not mean choosing a provider once and ignoring it. Revisit the legal entity, authorization, custody terms, fee schedule, supported withdrawal options and security disclosures when the provider changes its terms or your needs change. If you cannot confirm that the arrangement still fits, avoid adding funds until you understand the change.
